Hearing undertaken by European Parliament in the frame of alleged conflict of interest and misbehavior at EU of European Union Agency for Fundamental Rights

Dear President of European Parliament,

Under the right of access to documents in the EU treaties, as developed in Regulation 1049/2001, I am requesting documents which contain the following information:

1. The documents and minutes related to the evaluation and hearing undertaken by European Parliament in the frame of article 15 (3) third indent of the Council Regulation 168/2007 establishing a European Union Agency for Fundamental Rights.

2. The statement given by the Director of European Union Agency for Fundamental Rights before the competent committee of the European Parliament, under the same legal framework as above.

3. The relevant documents related to the decision taken by European Parliament vis-s-vis alleged cases of conflict of interest and misbehavior at European Union Agency for Fundamental Rights.

4. The European Parliament Decision to renew the mandate of the Director of FRA for 4 years (including minutes, notes, declarations given by MEPs in the same subject).

In response to your request regarding the Fundamental Rights Agency and more specifically concerning items 1, 2 and 4 of your request, the Council Regulation 168/2007 (Article 15 (3) third indent ) specifies that:

"The Management Board shall inform the European Parliament and the Council about its intention to extend the Director's mandate. Within a delay of one month before the Management Board formally takes the decision to extend this mandate, the Director may be asked to make a declaration before the competent committee of the European Parliament and to answer questions from its members".

The European Parliament has not yet undertaken any evaluation or hearing in this regard, but this procedure will take place during the course of May . Indeed, the competent committee, LIBE, decided at its meeting of 24-25 April to invite the Director of FRA to its meeting of 6 May. You will also be able to follow the meeting live, as it should be webstreamed.

Similar to the procedure followed in 2008 for the appointment of the Director, once LIBE has heard the candidate, the committee will give its opinion on the renewal of the mandate. This opinion will be transmitted to the Management Board of the FRA. Please bear in mind that the European Parliament has no decisional powers in this matter, as laid down in Article 15 of the Council Regulation 168/2007.

Concerning the alleged cases of conflict of interest and misbehavior at the FRA, you will find attached the report on the discharge for the FRA drafted by Mr Gerben-Jan Gerbrandy wich includes a motion for resolution with observations , as tabled for the plenary (A7-0102/2013) and its amendments

The report was adopted during the plenary session of 17 April(P7_TA-PROV(2013)0162).

Is there any improvement detected by EP following this Resolution. I see that EU Ombudsman opened a new harassment case at FRA
