Under the right of access to documents in the EU treaties, as developed in Regulation 1049/2001, I am requesting documents which contain the following information:
1.)the statement(s) made by Stavros Lambrinidis , EU Special Representative on Human Rights and any other member of the official EU delegation to the second UN Business and Human Rights Forum in December 2013.
2.)any documents, including briefings, meeting reports, commissioned external reports , communications between commissioners, consultations of corporations or consultations of NGOs relating to or discussing the implementation of potential, legally binding, sanctions for companies, who do not adhere to non-mandatory (not legally binding) human rights standards, as for example laid out in the UN Guiding Principles on Business and Human Rights or the ILO conventions on labour standards. To be more precise: any documents which touch on the possibility of holding corporations legally responsible, beyond their potential responsibility for violating individual's rights in civil court, for violating human rights, as laid out in the Universal Declaration of Human Rights, within the EU and abroad.
3.) any documents, including external and internal statements by Commissioners and their staff, as well as communications between individual Commissioners, which touch on the responsibility of businesses and particularly multinational corporations, to enforce (not necessarily legally-binding) human rights standards, as laid out in the above-mentioned guidelines, within the EU and outside of the EU. This entails not only the existing legal responsibility, but any general responsibility, not covered by existing legal frameworks.

you asked me to provide you with more detailed information regarding my request. I would like to do so.
However, I would firstly like to explain the reasoning for my request to demonstrate that I can only provide so much detail for the information I am requesting.
My request is based on the premise that the European Commission has firstly identified human rights as a prominent aspect of CSR in its renewed CSR strategy 2011-2014 and secondly identified "the need to consider self and co-regulation schemes" in order to increase the impact of CSR policies. In this context my request is necessarily phrased very broadly as it does not become obvious which steps the commission has undertaken to work towards this goal of specifically
- ensuring that human rights are being uphold by European businesses by means of particularly regulatory schemes.
I acknowledge that the Commission has held multistakeholder forums and has emphasized the importance of several international CSR and human rights guidelines, but it is not clear which particular (co-)regulatory have been discussed by the Commission and its commissioners. I would therefore like to repeat my request made in point 2 and 3 of my original request and would like to emphasize that the scope of the request is in so far limited as I am only and particularly asking for documents in relation to the discussion of mandatory, i.e. legally-binding legislation for the human rights practices of European businesses.
In regard to the points you asked me to specify I would to add the following:

-As for your request to point out specific corporations and NGOs I would like to emphasize again that I do not see how I could mention any particular business or NGO as I am not aware of any documents where the Commission has discussed with any third parties the particularly the implementation of legally binding schemes to observe human rights.
-Regarding your third point "commissioners and their staff" I hereby mean the directorate generals of the aforementioned commissioners and their staff.
-Regarding the specific time frame I would like to consider the period since the set-up of the Human Rights Working group in 1987, since this group already discussed the relation between business and human rights and had to deliver reports to the commission, which surely must have been discussed by the commissioners. (For the time frame before the current commissioners took their place, I, of course, only consider the documents considered by the according directorate generals)
-regarding the persons or bodies I am referring to the relevant directorate generals, as mentioned above.
I realize this request is still rather broad, but I do consider it particularly relevant as the Commission clearly identified human rights and businesses as a crucial factor and has further clearly indicated the need for regulatory measures, but has failed to publish any relevant documents and discussions of this topic beyond the report on the existing legal framework for human rights, available on the DG ENTR website.

Thank you for your request for access to documents sent to the European
Commission, DG ENTR, on 29 January, 2014, and the clarification you have
provided on 17 February. This reply is complementary to the reply that was
sent by the European External Action Service on 24 February 2014.
In your request you refer to the Commission´s Communication on “A new
strategy on Corporate Social Responsibility” (COM(2011) 681), specifically
to the action items regarding the improvement of co-/self-regulation
processes as well as the implementation of the UN Guiding Principles on
Business and Human Rights.
More specifically, you have asked the Commission whether any concrete
steps have been undertaken towards regulatory schemes regarding business
and human rights, more precisely what steps have been undertaken in order
to ensure “that human rights are being uphold by European businesses by
means of particularly regulatory schemes”.
Please allow us to clarify that the Commission's policy on CSR is built
upon a non-prescriptive approach and that the Commission has no intention
to make CSR legally binding. In this context, the Commission also has no
intention to introduce any regulatory schemes with regard to the UN
Guiding Principles on Business and Human Rights (UNGPs).
When you refer to the action item on co- and self-regulation in the
Commission's CSR Communication, it refers to a voluntarily process, which
has been acknowledged by the EU as part of the better regulation agenda
(please see the Inter-institutional Agreement on Better Law-Making 2003/C
321/-1, and the Commission Communication on "Better Regulation for Growth
and Jobs in the European Union (COM(2005) 97)). In such a process,
companies join a sector and/or multi-stakeholder initiative to address a
specific societal issue. The Commission can facilitate such a process, and
for this purpose a “Community of Practice” website has been launched by DG
CNECT (see
[1]https://ec.europa.eu/digital-agenda/en/c...).
As far as we are aware, no co- and self-regulation initiative regarding
business and human rights has been launched. For further information, we
would request you to get in contact with DG CNECT.
As regards the implementation of the UNGPs , the Commission has no
intention to introduce regulation. As outlined in the CSR Communication,
the Commission has published guiding material, in particular for SMEs and
industrial sectors (Oil & Gas, ICT, Employment & Recruitment Agencies) and
intends to publish a Staff Working Document on the UNGPs in the course of
this year. Moreover, it encourages companies to implement the UNGPs and
has included into its CSR peer review process with EU Member States the
development of national action plans on business and human rights as a
discussion item. So far, the UK, the Netherlands and Italy have published
national action plans.
In light of these policies, we don´t have any documents (briefings,
meeting reports, commissioned external reports, consultations of
corporations or NGOs) regarding the development/implementation of
potentially legally binding instruments or sanctions of companies that
don´t adhere to non-mandatory human rights standards (such as the UNGPs).
Notwithstanding, this does not mean that European companies are not
required to uphold human rights standards. In the EU, there exists a broad
body of legal instruments in order to ensure that human rights are
respected, including the EU fundamental rights charter, national
constitution law, relevant civil law, as well as EU secondary law, which
are applicable to legal entities, such as enterprises.
With regard to your request on the Human Rights Working Group and related
discussions, DG Enterprise is not responsible for this group and we
request you to contact the External Action Service in this respect.
Nevertheless, we believe that the following documents might be of interest
to you:

Thank you for your further request for documents.
You asked about the meeting of 20 December 2013. I enclose the agenda for
that meeting. By separate emails, I will send you what documents I have
that pertained to that meeting, with the proviso that:
- I did not necessarily send every document that could be of
use for the meeting at the time of the meeting itself. As soon as I
receive a document or have access to a relevant document, then I send it
to a contact list that I have for the High-Level Group of Member States
representatives on CSR as soon as possible. Then it is up to them whether
they bring the document to the meeting or not. This means that I regularly
send all sorts of documents to the HLG that might or might not be more or
less relevant for the meetings
- Presentations at the meeting take various forms: verbal
report without a presentation, verbal report with a (powerpoint)
presentation, or verbal report using a speech. Sometimes the written
contributions are sent to us and sometimes not.
My colleague Sophie Mueller may have complementary information to send you
in relation to one or other or both of the meetings you enquire about.
It would be useful for us to know why you need this information?
