Implementation status of Resolution 2001/2098(INI) on surveillance

Dear European Parliament,

Under the right of access to documents in the EU treaties, as developed in Regulation 1049/2001, I am requesting documents which contain the following information:

To which extent have the requests made by the Parliament in Resolution 2001/2098(INI) regarding the ECHELON system been implemented in practice by the Commission, other European organisations and public sector organisations in Member States, in particular the following points:

29. Urges the Commission and Member States to devise appropriate measures to promote, develop and manufacture European encryption technology and software and above all to support projects aimed at developing user-friendly open-source encryption software;

30. Calls on the Commission and Member States to promote software projects whose source text is made public (open-source software), as this is the only way of guaranteeing that no backdoors are built into programmes;

31. Calls on the Commission to lay down a standard for the level of security of e-mail software packages, placing those packages whose source code has not been made public in the ‘least reliable’ category;

32. Calls on the European institutions and the public administrations of the Member States systematically to encrypt e-mails, so that ultimately encryption becomes the norm;

33. Calls on the Community institutions and the public administrations of the Member States to provide training for their staff and make their staff familiar with new encryption technologies and techniques by means of the necessary practical training and courses;

Dear Sir,
 
Following your request of information regarding the follow-up of the
European Parliament resolution 2001/2098(INI) on ECHELON, we would like
to remind you that before the Lisbon Treaty, the European
Parliament  would only give recommendations in the Justice and Home
Affaires  (JHA) field.    
The Council was the competent institution for Third Pillar
matters, therefore you will find attached :
 
- Council resolution of 28/02/2002 (2002/C  43/02) on a common approach
and specific actions in the area of network and information security . 
 
- Council Framework Decision 2005/222/JHA of 24 February 2005 on attacks
against information systems ,  which states (Article 12) that Member
States shall take the necessary measures to comply with its provision by
16 March 2007. 
On 14 July 2008, the Commission produced a report on the implementation of
this Framework Decision ( COM (2008)448 - attached).  
 
In 2010, after the entry into force of the Lisbon Treaty, the Commission
presented a document to replace the latter Framework Decision, under the
ordinary legislative procedure ("codecision"):
Proposal for a Directive of the European Parliament and of the Council on
attacks against information systems and repealing Council Framework
Decision 2005/222/JHA (attached)
 
On 18 June 2013 the European Parliament produced its report (attached)  on
the proposal : 
Report on the Proposal for a Directive of the European Parliament and of
the Council on attacks against information systems and replacing Council
Framework Decision 2005/222/JHA (A7-0224/2013)
 
The debate / adoption is forseen  during next  plenary session (3 July)
