Europe Direct,

Dear Sir or Madam,
Thank you for your message. We would like to apologise for the delay.
Your message was forwarded to EUROPE DIRECT by the services of the Council
of the European Union. EUROPE DIRECT is a European Union (EU) information
service which answers factual questions about the EU. You can find further
information about EUROPE DIRECT at:
[1]http://europa.eu/europedirect/
Different services of the European Commission have been consulted in
preparation of this reply, namely the Commission departments
(Directorates-General -DG-) for Environment, for Enterprise and Industry
and for Health and Consumers.
Although your question is rather too general and needs to be specified in
order to provide you with a complete answer, the relevant services of the
European Commission have provided the following answers:
The Directorate-General for Environment does not have any information on
continued import of furniture from Asian countries made of non-compliant
wood composites.
According to the Directorate-General for Enterprise and Industry, Unit
F.3, there is no single legislation regulating wood composites in
furniture products as such, but rather various horizontal ones that would
cover furniture sector (wood composite), each from different aspects –
environment preservation, safety of workers, health of consumers etc. To
name just few, for example:
- The EU Timber Regulation ([2]Regulation (EU) No 995/2010*) that
prohibits the placing on the EU market for the first time of illegally
harvested timber and products derived from such timber;
- The Registration, Evaluation, Authorisation and Restriction of Chemical
substances (REACH) Regulation([3]Regulation (EC) No 1907/2006*) to improve
the protection of human health and the environment through the better and
earlier identification of the intrinsic properties of chemical substances
(used amongst others in furniture products);
- The General Product Safety Directive (GPSD, [4]Directive 2001/95/EC*)
(currently in the review) to protect consumer health and safety and to
ensure the proper functioning of the internal market.
Also the following publications may contain useful information to you:
- The FACTS II Guide provides an overview of mandatory legislations in the
area of health & safety and environment for furniture manufactures:
[5]http://www.ueanet.com/facts2/directives....
- The environmental legislations applicable to furniture sector are
explained on the website of the Directorate-General for Enterprise and
Industry):
[6]http://ec.europa.eu/enterprise/sectors/f...

Please see also the following European Commission Background Product
Report on Furniture:
[7]http://ec.europa.eu/environment/gpp/pdf/...

According to Directorate-General for Enterprise and Industry, Unit F.1,
restrictions in REACH are 'by chemical substance name'. It depends
therefore on which substance(s) you are referring to.
Also, enforcement is under the responsibility of EU Member States. The
relevant European Commission service is not aware of any particular
problems concerning wood composites.
The contact details for enforcement authorities in the Member States are
available on the website of the European Chemicals Agency (ECHA):
[8]http://echa.europa.eu/web/guest/about-us...
The Rapid Alert System (RAPEX) Team of the European Commission
Directorate-General for Health and Consumers (Unit B.3) cannot comment on
your questions because they are not specific enough to provide any input
concerning RAPEX.
Finally, information about access to EU documents is available on the
following website of the European Commission:

If you wish to have access to documents held by the Commission, please
