Dear Council of the European Union,

Under the right of access to documents in the EU treaties, as developed in Regulation 1049/2001, I am requesting the communication of all exchanges (emails, text and instant messages, letters, meeting agendas, meetings minutes, position papers sent, and any other material) that have taken place over the last 12 months between individuals of the Council of the European Union, at all levels of function involved at the IOTC, in fishing agreements’ matters, and the management of tropical tuna fisheries in general, with the lobbies Orthongel, Cepesca, Opagac, Anabac, Europêche, and UAPF, as well as with all the companies that are members of these structures (e.g. CFTO, Sapmer, Albacora, Echebastar, etc.).

Should these documents contain personal data, it is necessary that BLOOM still gets access to complete information including personal data. We are aware that Article 4 b) 1) provides an exception to freedom of information in case the disclosure would undermine the protection of privacy and the integrity of the individual, in particular in accordance with Community legislation regarding the protection of personal data. Article 9 1) b) of the Data Protection regulation states that “the recipient establishes that it is necessary to have the data transmitted for a specific purpose in the public interest”. According to the 28 recital of the regulation mentioned above, “the specific purpose in the public interest could relate to the transparency of Union institutions and bodies”.

As a marine conservation NGO, BLOOM fights opacity in the fishing sector. We request access to complete information and data, including personal data on EU Council staff members at every level, and on any other person with whom they have had contacts regarding the topic of interest here. Our request of unredacted data is in line with the specific purpose of public interest according to Article 9 1) b) of the Data Protection regulation.

Please note that I prefer to receive the requested documents in digital format rather than physical mail.

Dear Council of the European Union,

Please pass this on to the person who reviews confirmatory applications.

I am filing the following confirmatory application with regards to my access to documents request 'Information regarding EU tropical tuna lobbies'.

The response we have so far received from the Council is not satisfactory, as it is claimed that Council entities and tropical tuna lobbies have no relationships. Yet, such relationships between these two groups have long been established, e.g. by Corporate Europe Observatory (https://corporateeurope.org/en/power-lob...). Note that this report does not focus on *tuna* lobbies, but on industrial tuna lobbies in general, such as Europeche, whose Chair is Javier Garat, a shareholder of Alabacora, the EU's largest tuna fishing company, and whose many members are tropical tuna companies.

Furthermore, with regards to tropical tuna fisheries, Council has mandate to establish the official EU positions as part of IOTC negotiations. Therefore, we believe that the response from Council is not appropriate and that, should a proper review be done, relationships between Council entities and tropical tuna lobbies would be established (and communicated to us).

Thank you for your email here below.

 

We regret to inform you that, in accordance with Article 7(2) of
Regulation 1049/2001 regarding public access to documents, the deadline
for filing a confirmatory application on your access to documents request
‘Information regarding EU tropical tuna lobbies’ expired before you made
such a request. Accordingly, your confirmatory application is
inadmissible, and we have not registered it.

 

You may certainly, should you deem it opportune, file a new access to
documents request, in line with Article 7(1) of the said regulation.
