Under the right of access to documents in the EU treaties, as developed in Regulation 1049/2001, I am requesting documents which contain the following information:

All documents related to the infringement case INFR(2020)2342, relating to the Netherlands' transposition of the Basic Safety Standards Directive (Council Directive 2013/59/Euratom)

Since the case has been closed on 3/12/2020, article 4.2 of Regulation 1049/2001 does not apply here. Even if it were to be argued that it does, there is an overriding public interest, because of the importance of correct and swift transposition of the Directive - which is meant to guarantee "uniform basic safety standards for the protection of the health of individuals subject to occupational, medical and public exposures against the dangers arising from ionising radiation".

I write to you in reference to my application for access to documents, which was registered on 11/01/2022 under reference number GESTDEM 2022/0184.

The time limit to reply has expired on 1 February 2022. Regulation 1049/2001 only allows for an extension of that deadline in "exceptional cases", provided that the applicant "is notified in advance and that detailed reasons are given". I note that neither of these conditions have been met, and that this thus entitles me to make a confirmatory application.

I'm willing to wait another 48 hours before taking that step though, if the request can be handled within that additional period.

Dear Mr Teffer,

 

We refer to your e-mail of 11 January 2022, in which you make a request
for access to documents, registered on the 11^th of January under the
above mentioned reference numbers. Your applications are currently being
handled.

However, we will not be in a position to complete the handling of your
applications within the time limit of 15 working days, which expired on 01
February 2022.

An extended time limit is needed as the application concerns documents
held by different Services, which must be consulted.

Therefore, we have to extend the time limit with 15 working days in
accordance with Article 7(3) of Regulation (EC) No 1049/2001 regarding
public access to documents. The new time limit expires on 21 February
2022.

We apologize for this delay and for any inconvenience this may cause.

I write to you in reference to my application for access to documents, which was registered on 11 January 2022 under reference number GESTDEM 2022/0184.

The extended time limit to reply has expired on 21 February 2022. Regulation 1049/2001 only allows for an extension of that deadline in "exceptional cases", which I doubt is a criterion that is fulfilled by the need to consult different Services that hold the documents - the only reason given for the extended time limit.

Regardless, there is no legal basis in Regulation 1049/2001 for a further extension of the deadline beyond 2 x 15 working days, and DG Energy is therefore currently failing to meet the deadlines set in the Regulation - despite Commission President von der Leyen's explicit directive in 'The Working Methods of the European Commission' (dated 1 December 2019, P(2019) 2). The President stated: "Access to documents is governed by Regulation 1049/2001. Members of the Commission and services should respect the deadlines set by this regulation at all times."

I urge DG Energy to take the statements by the Commission president seriously, and to send a final reply without any delay.
