Infringement case PNR Netherlands

Dear Madam, Sir,

Under the right of access to documents in the EU treaties, as developed in Regulation 1049/2001, I am requesting documents which contain the following information:

All documents related to the infringement case INFR(2018)0208, relating to the Netherlands' transposition of Directive (EU) 2016/681 - on the use of passenger name record (PNR) data for the prevention, detection, investigation and prosecution of terrorist offences and serious crime

Since the case has been closed on 3/12/2020, article 4.2 of Regulation 1049/2001 does not apply here. Even if it were to be argued that it does, there is an overriding public interest, because of the importance of correct and swift transposition of the Directive - which according to the preamble has as its objectives "to ensure security, to protect the life and safety of persons, and to create a legal framework for the protection of PNR data with regard to their processing by competent authorities".

Dear Madam, Sir,

I write to you in relation to your handling of my application for access to documents, which was registered on 11 January 2022 under reference number GESTDEM 2022/0187.

You have granted the documents (with the exception of some personal data) within the 15 working days that is required by Regulation 1049/2001. While that should be the norm, unfortunately for many DG's replying on time is exceptional rather than standard. So I would like to take this time to express my appreciation that my request has been handled within the time limit and without an extension. Thank you.
