Dear European Parliament,

Under the right of access to documents in the EU treaties, as developed in Regulation 1049/2001, I am requesting documents which contain the following information:

All costs associated with the delegation to Australia, including flights, hotels and per diems and all other expenses for the mission which is set to take place 20-22 September 2022.

The delegation is composed by four Members, led by Mr Raphaël Glucksmann (S&D, FR), Mr Andreas Schieder (S&D, AT), Ms Isabel Wiseler-Lima (EPP, LU) and Mr Georgios Kyrtsos (Renew, EL).

But am also seeking the names of the advisors and any other EP official/staff that is joining the delegation.

Dear Mr Nielsen,

your request for public access to documents concerns documents that
contain personal data within the meaning of Article 3(1) of Regulation
(EU) 2018/1725. In light of Article 4(1)(b) of Regulation (EC) No
1049/2001, the possibility of undermining the protection of the integrity
of the individual must always be taken into consideration in the context
of applications for public access to documents containing personal data.
In that sense, Article 9(1)(b) of Regulation (EU) 2018/1725 provides that
the recipient of personal data must establish the necessity to have the
data transmitted for a specific purpose in the public interest.

In view of the above, we would like to ask you to establish that the
transmission of the personal data you have requested is necessary in the
above-mentioned sense.

The MEPs who went are already named. I do not need the names of staff, political advisors, assistants, etc. But could I just get a list of profiles instead? So how many staff, how many political advisors, etc and from which groups?

Dear Mr Nielsen,

we are writing you with regard to your application concerning the specific
costs associated with the ING2 committee mission to Australia of 20-22
September, as well as a list of participants.

We understand from your message of 3 October that you no longer seek any
documents containing personal data that is not already publicly available
and that your application therefore now concerns a list containing the
number and function of participants.

We have, in light of your modified application, identified a list of
participants of the ING2 committee mission to Australia of 20-22
September. Please note that marginal personal data have been redacted.

With regard to the expense declarations, which would normally contain the
kinds of costs you refer to in your application, we would like to note
that, apart from the fact that such documents would also contain personal
data, they are not yet available given that the time limit of three months
to submit the relevant expense declarations has not expired.

The request you refer to below led to the identification and disclosure of
just one document, a list of participants, available [1]here.

 

This was because we had understood your response to our request regarding
the necessity of the transfer of personal data to mean that you no longer
sought any documents containing personal data that is not already publicly
available.

 

As you know, in light of Article 4(1)(b) of Regulation (EC) No 1049/2001,
the possibility of undermining the protection of the integrity of the
individual must always be taken into consideration in the context of
applications for public access to documents containing personal data.

 

In that sense, Article 9(1)(b) of Regulation (EU) 2018/1725 provides that
the recipient of personal data must establish the necessity to have the
data transmitted for a specific purpose in the public interest. Only then
can Parliament's administration balance the public interest in the
transfer of the personal data in question and the private interest of the
data subject.

 

We would therefore ask you:

 

1)      To clarify if you would like to request public access to expense
declarations of the participants of the ING2 mission to Australia on 20-22
September 2022; and, if yes,

 

2)      To establish a specific purpose in the public interest that would
make the transfer of personal data possibly contained in those documents
necessary.

Thank you for your swift response. You posed the following two questions:

1. To clarify if you would like to request public access to expense
declarations of the participants of the ING2 mission to Australia on 20-22
September 2022; and, if yes,

My response: Yes

2. To establish a specific purpose in the public interest that would
make the transfer of personal data possibly contained in those documents
necessary.

My response: Public interest is environmental, given the length of the flights and accompany CO2 emissions.

Please note that the Aarhus Regulation recognises that public access to environmental information and in particular information relating to emissions into the environment, constitute a public interest.

And according to EU case-law, the transparency of a legislative procedure is a public interest that is relevant as regards assessing whether public access can be granted, as is the protection of the environment.

two documents. They have been published on the have now been published in
Parliament's Public Register of Documents under reference

Those documents contain the total amount of expense reimbursed to Members
and to Staff of the European Parliament, divided in travel costs, daily
allowance and accommodation costs.
