EXPLANATORY MEMORANDUM On the bill on the reform of legal profession
Romanian justice reform, in line with contemporary European standards,
is a major priority for the fulfillment of the conditions of accession of Romania
The European Union.
At Community level the legal profession is regulated in general by Directive
5 / 1998 to facilitate the exercise of the profession of lawyer on a permanent basis in another
than that in which it was acquired their professional qualifications and Directive 249/1977
to facilitate the effective exercise of freedom to provide services to attorneys.
The matter is the incidence and Directive 48/1989 on the general system of recognition
professional qualifications.
Directive 98/5/EC aims to eliminate obstacles to free movement of persons and
services for nationals of Member States, understood as the possibility to lawyers and
the job, as employees or on their own, in another Member State than the
professional qualification was obtained. In connection with the legislation in this field in Member
Community States, illustrative is the example of France, who unified the two professions
previously distinct (a lawyer and legal counsel), Law no. 1259/1990 for
amendment of Law no. 1130/1971 on the reform of judicial and legal professions.
According to Article 1 of this law created a new profession, liberal character
independent, whose members are appointed attorneys, which replaces the old professions of
lawyer and legal adviser. In this sense we have reached a publishing minutes on and
