Interpretation of EU LAW EC2201/2003 through European Court of Justice and SJ - DIR G JLS Team

Dear Legal Service,

Under the right of access to documents in the EU treaties, as developed in Regulation 1049/2001, I am requesting documents which contain the following information:

Introduction:
As there are serious concerns about the qualification and independence of the DG JUST members Michael Shotter (a British Lawyer) and Joanna Serdynska in their interpretation of EU LAW EC2201/2003 (Brussels IIa) e.g. it seems they don't consult SJ when making decisions and interpretation about this law

where DG JUST Shotter/Serdynska have never consulted SJ/Dir G — JLS Team (Justice, freedom and security, private law and criminal law)
before Joanna Serdynska '..said we cannot ..' but it seems they have never clarified this with SJ neither the DG JUST of the EU Commission has ever considered to start infringement proceedings against the Memberstate United Kindom

there is a need to get independet information.

When searching the EU court judgements:

it came out that there are always Agents from the EU Commission at the Court hearings.

Unfortunately DG JUST of the Commission
- seem to ignore the enforcement of the free moving court orders,
- has never recommended to bring such a issues to the EU Court
- neither they have informed about any decisions on this. Not to
-- to PETI Comitte,
-- to parents who suffer from EU laws where the EU Commission seems not to care about
-- neither they have started infringement proceedings.

Therefore I request:
(1) all documents about Brussels IIa (EC2201(2003) regulation work done in SJ
(2) Persons from SJ who worked for but also persons who joined the court cases who have been at the Luxembourg court hearings
(3) all Information within SJ about EC2201/2003 law where the subject of national enforcement of contact orders has been investigates, reviewed and decided. This includes court case (Luxembourg ans Strasbourg) who had an influence on this.
(4) information if there has ever been a member of SJ at the PETI comittee for clarification of EC2201/2003 and also Human rights issues when it came to child cases.
(Normally there are always members of DG JUST were I get more and more serious concerns)

can be considered requests for information. This information is public.  

 

As to your questions (2)  you can search and find this information in the
EUR-Lex database. For your help for searches in EUR-Lex I attach a Legal
Service internal help file which should allow you to better search in the
EUR-Lex database.

As to your question (4) we did not find a document in our archives which
states that a member of the Legal Service attended a meeting of the PETI
Committee. However, you may follow the work of the EP Committees which put
their meeting documents online.

Having replied to two of your 4 questions we are rather busy to deal with
your huge document request

 

(1) all documents about Brussels IIa (EC2201(2003) regulation work done in
SJ

(3) all Information within SJ about EC2201/2003 law where the subject of
national enforcement of contact orders has been investigates, reviewed and
decided. This includes court case (Luxembourg and Strasbourg) who had an
influence on this.

 

We are on the point to finish establishing the list of documents we then
will have to examine according regulation 1049/2001.

 

Therefore we will first of all

1) extend the deadline of our reply according to article 7(3) of
regulation 1049/2001. The new deadline will expire on 4 August 2015.

2)  ask you to find together a fair solution in application of article 6
(3). We will present to you as soon as possible a list of documents for
which we will ask you to establish an order of priority in our treatment.

inform you that we have listed the documents we found in our archives
falling under the scope of your request, namely under point 1 which reads

and the recognition and enforcement of judgments in matrimonial matters

Please be aware that the majority of the documents are written in French.

 

I'm writing to you in application of Regulation 1049/2001 article 6 (3) to
find a fair solution for handling the number of documents.

 

I suggest that we reply to you in bundles of 4 documents. You may indicate
the order in which you'd like us to handle them. As to the date of our
reply we suggest that we consider every bundle as a new request and apply
the procedure foreseen by Regulation 1049/2001. Our first reply will
therefore automatically trigger the handling of the next bundle of
documents.

 

One general remark: you ask for the Commission legal advice which has
contributed and led to the adoption of Regulation 2201/2003. As you know,
this is the final legal act that the Member states (MS) are bound to
apply. The information that you will partially find in the Commission
legal advice is of academic or historical nature today. Even in the case
where the final act differs from the legal advice given at the time this
does not change the legal act and the obligation of the MS.

 

In this context I'd like to kindly ask you to weigh up the limited added
value that you will get from the Legal Service documents against the
considerable work that you ask us to do. Having read the EP Petition
Committee documents from 29 August 2014, I am rather of the opinion that
you will not be able to use them in the UK because as said above the MS
are bound not by Commission Legal advice but by EU legal acts, in this
case Regulation 2201/2003.

 

In the third point of you request you ask for documents on "enforcement".
We did not find any of such documents in our archives. As to court cases
you must tell us the case number(s) which then allows us to see which
document(s) fall under the scope of you request.

Dear Legal Service,

the request has been done on 16th July 2015. It took until 20th January 2016 when the 1st part of the questions has been answered. I had asked several times but nothing was done.

In the meantime a father has been blamed from the PETI Chair Cecilia Wikström for his FOI requests. These FOI requests were necessary because the EU Ombudsman has rejected to investigate in saying there is an ongoing Petition.

Even worse, the Petition comittee has not investigated maladministration within the EU Commission (Departement Shotter).

Finally the petition committee has closed a Petition, in saying nothing can be done.

I request an immediate answer for the whole FOI request as this case has to go to the European Court of Justice.

Dear Legal Service,

this FOI request thas been made on 16 June 2015. There was cooperation from my side. It seems this cooperation was abused to delay further. And still its not done.

More and more I get the impression that the EU Commission - especially DG Justice - is not qualified to answer questions (e.g. in PETI hearings) and decide about violations of EU law. (see comments in PETI hearings from Margarete Tuite, Joanna Serdynska and Mr Grubisic etc).

EU citizens could get the impression that the EU Commission themself has given order to the legal service department to delay further and to avoid answers. Answers that could finally inform European Cititzens about maladministration within the EU commission.
