Legal advice and/or analysis of the legality on EU-Turkey agreements

Dear European Parliament,

Under the right of access to documents in the EU treaties, as developed in Regulation 1049/2001, I am requesting access to:

a) all documents generated or received by the Parliament containing the legal advice and/or analysis of the legality under EU and international law of the Agreement between the European Union and the Republic of Turkey on the readmission of persons residing without authorisation, OJ L 134, 7.5.2014

b) all documents generated or received by the Parliament containing legal advice and/or analysis of the legality of the actions to be carried out by the EU and its Member States in implementing the actions set out in the statement on the agreement reached with Turkey at the summit held on 7 March 2016 (statement here: http://www.consilium.europa.eu/en/press/...). I am interested in documents drawn up both before and since the meeting was held, to date.

In dealing with your application and after consultation with the
secretariat of the relevant committee as well as Parliament’s Legal
Service, Parliament could identify no documents containing legal advice,
neither related to the 2014 Agreement, nor to the EU-Turkey statement of
18 March 2016. However, as concerns the second part of each of your two
questions, several documents have been identified dealing with legal
aspects of readmission agreements in the context EU and international law.

 

With reference to the 2014 agreement please find in attach a background
note drafted in October 2012, as well as the link on Parliament’s website

The joint statement  of the EU Heads of States and Governments of 18 March
2016  (EU-Turkey statement,  see

to be understood as a political document  which sets out common political
understanding on the EU-Turkey relations, builds on the principles set out
on 7 March 2016 (see

The framework is set out in the Commission's Communication

of 16 March 2016. This statement is not an international agreement in the
meaning of the treaty (Art. 218 TFEU), providing for Parliament
consultation.

 

As regards Parliament’s political assessment  a debate with Council
President Donald Tusk and Commission President Jean-Claude Juncker will
take place during the next plenary session on Wednesday 13 April in the
