An extended time limit is needed as your application implies consultation
of third parties on the disclosure and a research in the historical

New deadline 15 October 2013

From your reply I gather that DG EMPL has identified the letter in the electronic mail register

Considering the fact that it concerns a letter of 2 Members of the European Parliament to a Commissioner, I question if agreement for disclosure of the third party (MEPs)is needed.

The Code of Conduct for Members of the European Parliament states that in exercising their duties, Members of the European Parliament:
(a) are guided by and observe the following general principles of conduct:
disinterest, integrity, openness, diligence, honesty, accountability and
respect for Parliament’s reputation,

Considering the special interest that the two MEP's had in the issue of intercountry adoption,

I consider that there is a public interest to disclose this letter without further delay.

As the reply was signed by the Civil Justice Unit, I conclude that the letter will be further dealt with by DG JUST.

I hereby request you to make the letter public, while at the same time DG JUST can continue to check their historical archives (which I assume are also electronic).

Please pass this on to the the General Secretariat's Transparency Unit for a Freedom of Information review (confirmatory appeal).

I am writing to request an internal review of DG JUST's handling of my FOI request 'Letter MEPs Gibault and Cavada'.

The original request of 26 August was to DG EMPL.
On 28 Ausgust I received an acknowledgment of receipt of the Secretariat General and a time limit of 18 September.

On 17 September I received a reply of DG JUST, Civil Justice Policy Unit (no name) giving a new time limit, being 15 October. However, below that reply was the internal mail with which DG EMPL transfered my request to DG JUST. From that internal mail it became clear that the requested letter had been identified in DG EMPL's electronic mail register.

I replied on 19 September, providing arguments why I consider there is a public interest in disclosure of the letter without further delay.

Today I received another reply, this time from the CIVIL JUSTICE ACCESS TO DOCUMENTS TEAM (no name) setting the time limit on 9 October, with the following justification: "An extended time limit is needed as your application as the application concerns documents originated by different Services which must be consulted".

I kindly request you to look into the way my request is being handled.

Please pass this on to the person who conducts Freedom of Information reviews.

I am writing to request an internal review (confirmatory application) of DG JUST's handling of my FOI request 'Letter MEPs Gibault and Cavada'.

I have received the letter to which I requested access as well as the reply of Commissioner Spidla.

However, as these letters now came from DG JUST, I am - as said before - interested in DG JUST's follow-up given to this letter of MEPs Gibault and Cavada.

In an earlier request for access to documents, I asked about correspondence received by the Commission both from Members of the European Parliament and citizens/associations, in the period between 1/1/2006 and 1/6/2010 to which this study (Comparative study on the adoption procedures in EU Member States) was a follow-up. The letter of MEPs Cavada/Gibault was not disclosed then, while it does relate to it.

Reply - Internal review of access to information request - Letter MEPs
Gibault and Cavada

Dear Mr Dohle,

Following your request of internal review of 20 October below, please find
here the reply from DG Justice.

You should have noticed that the answer of Commissioner Spidla to MEPs
Cavada and Gibault mention both a possible study on adoption issues and an
initiative on European adoptions which took place on 9 November 2006 at
the European Parliament. You already know that Vice-President Frattini
commissioned a comparative study on adoption which has been the subject of
previous requests of access to documents. We hereby confirm also that
Vice-President Frattini participated to the initiative organized by the
European Parliament on 9 November 2006.

Concerning the fact that the letter from MEPs Cavada and Gibault to
Commissioner Spidla was not disclosed earlier by DG Justice, the reason is
that DG Justice was not even aware of the existence of this exchange of
letters, as the letter of 23-8-2006 from the MEPs was addressed to
Commissioner Spidla and not to Vice-President Frattini. A research in the
historical archives of Commissioner Spidla has been carried out in order
to answer to your request.

Concerning your request related to GESTDEM 3117/2013, for which you
already sent on 20 September a confirmatory appeal, please be aware that
you have received most part of the correspondence available to DG Justice
already on 19/7/2013.  Moreover, the letters from the associations (like
Amici dei Bambini, Amici dell'Adozione, etc) had been the subject of other
requests of yours and you have already received the answer. There are
still few letters from citizens for which we are collecting the permission
to disclose and that will be forwarded to you as soon as possible.
