Dear European Ombudsman,
Please pass this on to the person who reviews confirmatory applications.
I am filing the following confirmatory application with regards to my access to documents request 'letter Mrs. Roelie Post - whistleblower'.
The reply received, see below, is not what we asked for.
We requested:
A printout of the registration sheet, showing the workflow, related to the letter sent to the European Ombudsman's office in February 2016 by whistleblower Roelie Post, including any correspondence, documents, related to it.
In other words, I request access to the registration details about the letter Mrs. Roelie Post sent you in copy in February 2016. Either the ARES registration number, date, workflow - or the case registration number and any documents/correspondence related to it.
To be especially precise: we request access to the data/information related to the registration of the letter addressed to EP President Martin Schulz, copied to the European Ombudsman, in February 2016.
Considering the simplicity, sensitivity, and importance of this request, we expect a reply before the end of the week.
Yours faithfully,
Arun Dohle

Dear Mr Dohle,
I am writing in reply to your request for public access to documents.
On 22 August 2021, via the platform asktheeu.org<https://www.asktheeu.org/en>, you asked the European Ombudsman’s Office to grant you public access to “the registration sheet” of a letter sent by a third person (‘the person concerned’), to the Ombudsman and “any documents related to it”.
We have registered your request on 26 August 2021 under the reference Ares(2021)5284327.
We have dealt with your request in accordance with Regulation 1049/2001[1] regarding public access to documents and the Ombudsman’s Decision on the handling of requests for public access to documents[2].
Concerning the ‘registration sheet’, please note that all incoming correspondence to the Ombudsman is dully registered. General correspondence is registered in our documents management system (ARES). Case related correspondence is registered in our case management system directly in the relevant case file. Statistical and registration information are integrated in the internal notes. Given that no such document exists, I am sorry to inform you that we are not in a position to fulfil this part of your request[3].
Following a thorough research in our records, we have identified the following four documents as falling with the scope of your request:
1. NOTE_201501349_20160115_105600
2. DECISION_201501349_20160115_104600
3. MAIL_201501349_20160118_093100
4. MAIL_201501349_20160120_105800
On 6 June 2017, we have granted you full access to the first two documents and partial access to the remaining documents in the framework of your previous public access request Ares(2017)2592022. You did not make use of the possibility to request a review of the decision on your previous request.
Should you wish to challenge this decision, you may request a review under Article 7(2) of Regulation 1049/2001 (‘confirmatory application’ procedure). You may do so by sending an e-mail to [European Ombudsman request email]<mailto:[European Ombudsman request email]> within 15 working days of having received this decision. Our Secretary-General will then handle the review request.
I hope you will find the above information useful and you are welcome to contact me through our office e-mail with any questions or requests for clarifications you may have.
Yours sincerely,
Tereza Mandjukova"

Dear European Ombudsman,
We stick to this:
Considering the simplicity, sensitivity, and importance of this request, we expect a reply before the end of the week.
This case is dragging on since 2016. And has left a lot of scorched earth.
There is an urgent need to get out of this impasse.
If EO cannot provide a reply to this simple request, we consider that either the letter has not been registered (cover-up), or was registered but the EO does not want this Ares sheet to become public (cover-up).
Yours sincerely,
Arun Dohle

Dear European Ombudsman,
I write with regards to my access to documents request 'letter Mrs. Roelie Post - whistleblower'.
From the reply received it does not become clear if the whistleblower letter was formally registered, or not.
You refer to the fact that later, in 2017, a complaint on this matter was handed in.
However, before this whistleblower-letter there were already many complaints and other news about this very serious matter. An 'own initiative investigation' would have been justified. Instead the letter was likely not registered, and in any case not followed up.
You may know that this issue is fully in the public domain since 2007. Numerous newspaper particle, documentaries, podcasts have been broadcasted worldwide. All this has resulted in a resolution that was unanimously adopted by the Dutch Parliament in 2019.
As for the public interest, there is growing interest in the subject of trafficking for children for adoption. Since the presentation of the Dark Side of Adoption, including the movie THE TRAFFICKERS, at the European Parliament in November 2018, there have been more and more national investigations launched. Some governments have offered apologies.
All this is closely connected to this whistleblowing-letter about the European Commission's treatment of the Task Manager of the Romanian Children File. It is, therefore, in the public interest, the public good, to understand how whistleblowers are being dealt with. This also in view of future whistleblowers who need to understand the Europen Institution's attitude and actions towards whistleblowers.
It is of course never too late to still provide whistleblower protection in line with the COM's guidelines, which we and many others would very much welcome.
A full history of my request and all correspondence is available on the Internet at this address: https://www.asktheeu.org/en/request/lett...
Yours faithfully,
Arun Dohle
