List of active MEPs with information on respective committees

We're waiting for A Makela to read a recent response and update the status.

Dear European Parliament,

Under the right of access to documents in the EU treaties, as developed in Regulation 1049/2001, I am requesting documents which contain the following information:

An excel file with the current list of MEPs which includes their functions and positions in the various committees and delegations.

Essentially, an updated version of the "EP-PE_LMEPS(2018)0001" excel file, found here: http://www.europarl.europa.eu/RegistreWe...

But with the addition of an up to date sheet with functions as seen in the seen in the 2016 version. File name: EP-PE_LMEPS(2016)0001

machine readable format is now available on the Public Register of
Documents, as well as the latest version of the "List of Members" .

We' like to draw your attention to the fact that the lists are not updated
every time a Member leaves office, but once or twice a year.

The europarl website members tab

I am filing the following confirmatory application with regards to my access to documents request 'List of active MEPs with information on respective committees'.

The document that was referred to in the answer, (EP-PE_LMEPS(2018)0002), does include an update to date list of active MEPs and their committees, but not their functions within those Committees. The answer only gave partial information to the request.

Would it be possible to access an updated excel file, with an identical format to EP-PE_LMEPS(2016)0001, which includes a sheet for general MEP information and a separate sheet for their functions across the multiple committees and delegations (i.e. whether they are substitutes, members, vice-chairs, chairs, etc.)?

I am filing the following confirmatory application with regards to my access to documents request 'List of active MEPs with information on respective committees'.

Thank you for updating the document. However, it is still missing information about what roles MEPs serve in the committees and delegations (roles such as chairs, vice-chairs, etc.) as seen in the 2016 format.

Additionally, while a lot of information is on the sheet, it is not machine-readable. The ***identical format*** to EP-PE_LMEPS(2016)0001 and its "fonction" sheet is ideal. With one row for each MEP for each of their positions on different committees and delegations. This makes it easy to navigate, cluster, and dissect different datasets. For example in the 2016 format's "fonction" sheet, Lars ADAKTUSSON had 6 rows listing information in the following way.

Substitute TRAN
Vice-Chair D-AF
Substitute DSEE
Member EPP
Member DROI

This format makes it easily searchable via pivot tables and other means of data analysis.
Could you kindly update the latest file to this format? This would make the document more accessible and searchable.

Dear Mr. Makela,

 

This is a reply to your email of 30 May 2018 in the context of your
application, submitted under Regulation (EC) No 1049/2001 of the European
Parliament and of the Council of 30 May 2001 regarding public access to
European Parliament, Council and Commission documents (Regulation
1049/2001), with reference no. A(2018)6125, registered on 24 May.

 

In your email you claim that, in spite of the updated document that
Parliament has published on its Public Register of Documents following
your application of 24 May, “it is still missing information about what
roles MEPs serve in the committees and delegations [...]”.

 

In the first place, Parliament would like to inform you that the scope of
Regulation 1049/2001, as defined in its Article 2(3), extends only to
documents held by an institution.

 

It is necessary thus, according to well-established case-law, to maintain
a distinction between the concept of a document and that of information,
for the purposes of applying Regulation 1049/2001.

 

Indeed, the General Court establishes that information may be
distinguished from a document, in so far as information is defined as a
data element that may appear in one or more documents. In that respect,
since none of the provisions of Regulation 1049/2001 deals with the right
of access to information as such, it cannot be inferred that the public’s
right of access to an institution document implies a duty on the part of
the institution to reply to any request for information from an
individual.

 

In addition, the Court considers that the right of access to documents
held by the institutions within the meaning of Article 2(3) of Regulation
1049/2001 applies only to existing documents in the possession of the
institution concerned. Therefore, an application for access to documents
that would require the institution to create a new document, even if that
document were based on information already appearing in existing documents
held by it, does not fall within the scope of Regulation 1049/2001. This
conclusion is implicitly confirmed by Article 10(3) of Regulation
1049/2001 that stipulates that documents to which access is granted have
to be supplied in an existing version and format.

 

Parliament has identified the relevant and most updated document that
falls within the scope of your application and has made it publicly
available via its Public Register of Documents following your application.
By email of 29 May, Parliament has provided you with a direct link, for
your convenience, to this document published on the Register.

 

Please be informed that Parliament’s duty under Regulation 1049/2001 ends
here and it is not bound to change an existing document by adding
additional information in order to meet the needs of a given requester.

 

In addition, Parliament would also like to inform you that according to
Article 7(2) of Regulation 1049/2001, the applicant has the right of
making a confirmatory application “in the event of a total or partial
refusal” of the document falling within the scope of the application. This
is not the case here, where Parliament has given full public access via
its Register to the relevant document. Moreover, Article 7(4) stipulates
that “failure by the institution to reply within the prescribed time-limit
shall entitle the applicant to make a confirmatory application”. Again,
this is not the case here since Parliament has given full public access to
the relevant document well before the deadline for your application, that
is to say, before the 14 of June.

 

On this basis, Parliament considers your request as handled and the file
closed. Please do not hesitate to come back to us, should you have any new
request for specific Parliament documents.
