Dear Permanent Representation of Portugal to the EU,

Under the right of access to documents in the EU treaties, as
developed in Regulation 1049/2001, I am requesting documents which contain the following information:

How many meetings have employees of the Portugese Permanent
Representation to the EU had with representatives of companies, organisations and other stakeholders, during the last 12 months? I would like to request a list of these meetings: who was present at the meeting, including the names of organisations/lobbyists presents, as well as the date of the meeting and the subject matter discussed.

Dear Mr. Luke,

Our reading of the regulation you quote is that it is related to public access to European Parliament, Council and Commission documents. However, you are requesting information held by this Permanent Representation, which is none of those European institutions mentioned in the Regulation. Furthermore, the type of information you are requesting is not contained in documents issued by those institutions.

It is therefore our understanding, after having consulted my authorities, that your request cannot be responded to under the regulation you are quoting.

Please excuse the incorrect regulation quoted, which was included from a previous request to a different Permanent Representation. The correct regulation is Regime de Acceso: Law no. 46/2007. Under this regulation I would like to request documents about the following information:

How many meetings have employees of the Portugese Permanent Representation to the EU had with representatives of companies, organisations and other stakeholders, during the last 12 months? thank you for your new request, amending the grounds of your first
request.

After a consultation of our competent authorities in Lisbon, we would like
to inform you of the following:

1.      The Portuguese Law 46/2007, of 24 Aug 2007, rules the public
access to administrative documents and their re-use, adopting Directive
2003/98/CE of the European Parliament and of the Council, of 17 Nov 2003,
on the re-use of public sector information. According to article 5 of the
law, “everyone has a right of access to administrative documents, without
having to state a reason for the request, and that right comprises the
right of consulting, reproducing or getting information about the
existence and content of the document”.  

2.      Experts and practitioners have generally been reading this law,
namely its article 11, para. 5 (means of having access to documents), in a
way that public services are only obliged to grant access (by
consultation, reproduction or by a certificate) to documents which
actually exist and which are in their possession. We firmly believe that
public services are not obliged to accept requests of unstructured or
“massified” information which needs to be searched, collected and
produced, especially when that involves a disproportionate effort. This is
clearly the case, because the Portuguese Permanent Representation does not
possess such a document with the information you requested.

3.      Moreover, even if that document existed and was in our possession,
which is not the case, you would have to identify it in a reasonably clear
way in order to the direct access be granted.

Therefore, your request of access to a list of meetings between the PR of
Portugal and representatives of organisations, companies and other
stakeholders held on the last 12 months, including names of participants,
dates and subject of those meetings, cannot be accepted.
