Dear Ms Eberhardt,
We refer to your request for access to documents submitted on 22 May 2024
and registered on 23 May 2024 under case number 2024/2686.
Your application concerns a very large number of documents, which need to
be retrieved and assessed individually. Such a detailed analysis cannot be
carried out within the normal time limits set out in Article 7 of
Regulation (EC) No 1049/2001. In addition, we have also to consult third
parties asking their opinion on the possible disclosure of the identified
documents.
However, Article 6(3) of Regulation (EC) No 1049/2001 provides for a
possibility to confer with an applicant informally with a view to finding
a fair solution when an application relates to a very long document or
concerns a very large number of documents.
In accordance with the case law of the EU Courts, such a solution can only
concern the content, or the number of documents requested, not the
deadline for replying. This means that the scope of the request must be
reduced in a way that would enable its processing within the extended
deadline of 15 + 15 working days.
Based on the above-mentioned provision, we would like to ask you to narrow
down the scope of your application to the five most recent meetings, in
order to reduce it to a manageable number of documents. Another request
for access to documents could be submitted later to request additional
documents, if needed.

Unfortunately, I cannot reduce the number of documents to the five most recent meetings as you suggest.
But I can offer to narrow the scope of the request to lobby contacts that took place in 2023, so a total of 9 instead of 14 meetings (i.e. more than one third less). Allow me to stress that the request refers to contacts with only two lobby groups and to meetings that were already disclosed by the Commission, which should make consultations with third parties manageable.
If you cannot accept my suggestion, could you please provide me with a list of the exact documents that fall under the original scope of the request? This would allow me to make an informed decision about reducing the scope further. Without knowing what documents exactly you are talking about and their amount, this is, unfortunately, not possible for me.

I am filing the following confirmatory application with regards to my access to documents request 'Lobby contacts with DSGV and VÖB' (2024/2686).
I submitted the request on 22 May - nearly four months ago. Following your proposal for a fair solution I reduced my request by one third on 27 May. After the extended deadline for your reply passed on 4 July, I asked for an update from your side on 17 July and then again on 3 September, but did not get any response.
According to Regulation 1049/2001, the failure to take an initial decision on a request within 30 working days may be considered an implicit refusal. In such cases, requesters may make a confirmatory application, which is what I am doing here.
The Commission should correct the situation and promptly release the requested documents.
