I am writing to you in reply to the request for public access to documents
that you submitted to the European Ombudsman’s Office on 4 September 2018.
It was registered under the reference ARES(2018)4575794. Please use that
reference in case of further correspondence when referring to your
request.

Your request is dealt with in accordance with Regulation 1049/2001
regarding public access to European Parliament, Council and Commission
documents and the Decision of the European Ombudsman on internal
procedures for dealing with applications for public access to documents
and requests for information.

In your request you stated that the inquiry is 'completed', however
actually the inquiry is still ongoing. Following the findings of the
Ombudsman, the European Commission now has three months to respond before
the closing decision will be issued.

The remaining correspondence between the Ombudsman, the European
Commission and Mr Selmayr is currently being analysed. It mainly contains
e-mails exchanges between officials working in both institutions part of
which relate to simple organisational or procedural aspects. They are
technical in nature and shall therefore not be published on our website.
These documents will however be processed in your request for access to
documents. Because the inquiry is still ongoing, the Ombudsman's Office
needs to carefully consider whether granting partial access to some of the
documents at this stage of the inquiry would risk undermining the course
of the current investigation. We shall therefore need to extend the
deadline for the reply by 15 working days and come back to you no later
than 17 October 2018.

Dear Mr Abdul Hai,

As a follow-up to our first reply of 26 September 2018 (ref.
Ares(2018)4943894) to your request for public access to documents
registered by the European Ombudsman on 4 September 2018 (ref.
ARES(2018)4575794), I am pleased to send you further documents.

As explained in our first reply these are mainly e-mails exchanges between
officials working in both institutions part of which relate to simple
organisational or procedural aspects.

Your request has been dealt with in accordance with Regulation
1049/2001[7]^[1] and the Ombudsman’s Decision on the handling of requests
for public access to documents [8]^[2].

We apologise for the slight delay that occurred when dealing with the
second part of the reply to your request.

Please note that the redactions in the attached documents have been
implemented with a view to protect personal data in accordance with
Article 4(1)b of Regulation 1049/2001 (on the protection of privacy and
the integrity of the individual), which implicitly refers to Regulation
45/2001 on the protection of personal data. Further redactions have been
made with the aim of reducing the risk of online crawlers detecting
e-mails addresses for the purpose of 'spam'.

If you wish to formally pursue any issues with our current response,
please note that you are free to do so through a request for review under
Regulation 1049/2001 (‘confirmatory application’ procedure) in response to
