I am filing the following confirmatory application with regards to my access to documents request 'Meeting between Thierry Breton and Publicis consultants'.

The refusal is based on the presumption that the DG does not hold any document of this meeting.
My arguments in favour of disclosure are the following:

I see an overriding public interest in disclosure of the requested information as the meeting was related to DSA, a new policy which affects all EU citizens. The public should have the right to know how major decisions are taken on such a sensitive topic.

Furthermore, Regulation 1049/2001 states that "the institutions shall develop good administrative practices in order to facilitate the exercise of the right of access guaranteed by this Regulation". The DG should have kept records of this meeting. It is of good administrative practice to keep a record of all Commissioner meetings.

I refer to your letter of 18 January 2021, registered on the same day, by
which you submit a confirmatory application in accordance with Article
7(2) of Regulation (EC) No 1049/2001 regarding public access to European
Parliament, Council and Commission documents[6]^^[1] ("Regulation
1049/2001").

Your confirmatory request is currently being handled. However, we will not
be in a position to reply to your confirmatory request within the
prescribed time limit expiring on 8 February 2021. Consequently, we have
to extend this period by another 15 working days in accordance with
Article 8(2) of Regulation 1049/2001. The new deadline expires on 1 March
2021.
