Dear Directorate-General for Environment,

Under the right of access to documents in the EU treaties, as developed in Regulation 1049/2001, I am requesting documents which contain the following information:

- a list of meetings of DG Environment officials and/or representatives (including the Commissioner and the Cabinet) and representatives of individual Canadian-headquartered companies (including lobby consultancies and law firms), and/or industry associations, in which the Fuel Quality Directive (FQD) was dealt with (between April 2011 and today);

- minutes and other documents of these meetings (agenda, list of participants, etc.);

- documents submitted by the Canadian-headquartered companies (including lobby consultancies and law firms), and/or industry associations as part of these meetings;

- all correspondence (including emails) between DG Environment officials and/or representatives (including the Commissioner and the Cabinet) and representatives of individual Canadian-headquartered companies (including lobby consultancies and law firms) and/or industry associations, in which in which the Fuel Quality Directive (FQD) was dealt with (between April 2011 and today).

I refer to your email of 4 March 2015, in which you submit a request
documents which contain the following information:

 

- a list of meetings of DG Environment officials and/or representatives
(including the Commissioner and the Cabinet) and representatives of
individual Canadian-headquartered companies (including lobby consultancies
and law firms), and/or industry associations, in which the Fuel Quality
Directive (FQD) was dealt with (between April 2011 and today);

 

- minutes and other documents of these meetings (agenda, list of
participants, etc.);

 

- documents submitted by the Canadian-headquartered companies (including
lobby consultancies and law firms), and/or industry associations as part
of these meetings;

 

- all correspondence (including emails) between DG Environment officials
and/or representatives (including the Commissioner and the Cabinet) and
representatives of individual Canadian-headquartered companies (including
lobby consultancies and law firms) and/or industry associations, in which
in which the Fuel Quality Directive (FQD) was dealt with (between April
2011 and today).

 

This is a very broadly formulated request. The description given in your
letter does not enable us to identify concrete documents which would
correspond to your request. Consequently, we are unable to handle your
request in its present form.

 

We therefore invite you, pursuant to Article 6(2) of Regulation (EC) No
1049/2001 regarding public access to documents, to make a more targeted
request and provide us with more detailed information on the documents
which you seek to obtain, such as the subject /scope of the request,
references, dates and more specific periods during which the document
would have been produced, names of the companies and law firms you are
referring to, persons who drafted the documents and provide us with any
other relevant information which would enable us to identify the documents
falling under your request.

 

You will no doubt understand that such broad request cannot be handled in
accordance with the normal rules on access to documents. The search for
documents that might fall within the scope of such request would take
considerable time, as the archives are not designed for this type of
search. Moreover, the Commissioner and his Cabinet took the office in
November 2014 only. We would, therefore, suggest that you narrow down the
scope of your application in order to enable the Commission services
concerned to handle them without creating disproportionate administrative
burden.

 

The 15 working days' time limit for handling your application will start
running when we receive the requested clarification.

ask you to provide us with more detailed information on the
representatives of individual Canadian-headquartered companies ( i.e. on
the names of these companies and law firms or lobby consultancies) you are
referring to in your request including the names of the persons who
drafted the documents and provide us with any other relevant information
which would enable us to identify the documents falling under your
request.
