I have sent a number of freedom of information (FoI) requests in connection with a significant number of meetings between FISMA and representatives of corporations and trade associations. In the majority of documents returned under the FoI requests, however, the disclosure has been limited to the exchange of emails between FISMA representatives and those of industry. Almost no information has been provided on the actual content of the meetings. My question is, does FISMA or does FISMA not have a system in place whereby meetings with industry representatives are recorded (e.g. minuted)? And if so, why have these records not been disclosed?

Capital Markets Union, who dealt with these requests at the initial stage,
provided the reply to the applications GESTDEM 2019/2228, GESTDEM
2019/2225 and GESTDEM 2019/2240.

 

Concerning your confirmatory request, we would kindly ask you to provide
the clarification concerning the following two points:

 

a)       In your confirmatory application you pose the following question:
‘does FISMA or does FISMA not have a system in place whereby meetings with
industry representatives are recorded (e.g. minuted)? And if so, why have
these records not been disclosed?’

 

It seems that this question is rather a request for information and not a
request for documents. Please note that right for access to documents
under Regulation (EC) No 1049/2001[6][1] refers only to the documents and
not to the information as such. We would therefore kindly ask you to
clarify if your confirmatory request concerns access to information or
access to documents. In the latter case, please specify the scope of your
confirmatory application.

 

b)      In your confirmatory application you refer to 'Meetings between
FISMA and Industry regarding the Sustainable Finance Package/Green
Finance'. Since the Directorate-General for Financial Stability, Financial
Services and Capital Markets Union provided the reply to applications
GESTDEM 2019/2228, GESTDEM 2019/2225 and GESTDEM 2019/2240 it is not clear
to which of these three requests you refer. We would kindly ask you to
specify this point as well.

To clarify, my request concerns all documents which specify the official requirements of FISMA Members of Cabinet to create or not to create a physical or digital record of their meetings with industry representatives. In this case, the term ‘industry representatives’ refers to employees of organizations listed in ‘In-house lobbyists and trade/business/professional associations’ section of the EU transparency register.

As you have correctly noted, my previous request referred to meetings between FISMA and Industry regarding the Sustainable Finance Package/Green Finance. To clarify, this refers to the response provided to applications GESTDEM 2019/2228, GESTDEM 2019/2225 and GESTDEM 2019/2240.

We confirm that the scope of your confirmatory application now includes
the meeting minutes for the meetings requested in the initial applications
GESTDEM 2019/2228, GESTDEM 2019/2225 and GESTDEM 2019/2240. We will try to
provide you with a reply as soon as possible.

 

In addition, in your reply to our clarification letter, you indicate that
you are interested in 'all documents which specify the official

representatives.  In this case, the term ‘industry representatives’ refers
to employees of organizations listed in ‘In-house lobbyists and

register.' However it seems that you are requesting new types of documents
which were not in the scope of the initial applications you submitted.

 

Therefore, this part will not be treated in the context of this
confirmatory application. Instead, a new initial application has been
created under reference Gestdem 2019/4149 for this part and assigned to

Dear Mr O'Connor,
I refer to your letter of 17 June 2019, registered on 18 June 2019, by
which you submit a confirmatory application in accordance with Article
7(2) of Regulation (EC) No 1049/2001 regarding public access to European
Parliament, Council and Commission documents[6]^^[1] ("Regulation
1049/2001").

Your confirmatory application is currently being handled. Unfortunately,
we have not yet been able to gather all the elements we need to carry out
a full analysis of your request in order to take a final decision and,
therefore, we are not in a position to reply to your confirmatory request
within the 15 working days of the registration of the application. Please
note that this deadline stopped running on 5 July 2019 when the Commission
sent you a clarification letter and resumed on 16 July when you sent your
reply. In other words, the first deadline expires on 22 July 2019.

Consequently, we have to extend this period by another 15 working days in
accordance with Article 8(2) of Regulation 1049/2001. The new deadline
expires on 12 August  2019.
