concrete documents corresponding to your request. We therefore invite you,

- We would like to receive all documents since 01/11/2014
- ATOS SE indeed excludes the subsidiaries of ATOS.
- Our request also covers meetings where ATOS was present with other companies.
- We would like to receive both policy-making related meetings as well as meetings concerning projects in which ATOS SE was involved.
- The request covers meetings between ATOS and all representatives of DG Connect (so the political level as well as the administrative level).

We refer to your e-mail, dated 25 October 2019 wherein you make a request
for access to documents, pursuant to Regulation (EC) No 1049/2001 of the
European Parliament and of the Council of 30 May 2001 regarding public
access to European Parliament, Council and Commission documents
(hereinafter ‘Regulation 1049/2001’), registered on the same date under
the above-mentioned reference number. We also refer to our clarification
request, dated 30 October 2019, our reference Ares (2019)6732620 and to
your reply dated 31 October 2019, our reference Ares (2019)6802304.
By your application, you request access to:
‘’all documents –included but not limited to emails, reports, minutes,
etc.- relating to meetings with the company ATOS SE’’.
In your email of 31 October 2019 you further clarified:
- Your request covers documents since 1/11/2014.
- ATOS SE subsidiaries are excluded from the scope of this request.
- Your request concerns not only meetings where only ATOS SE was
represented but also meetings in which ATOS SE together with other
companies was present.
- Both policy-making related meetings and meetings concerning projects in
which ATOS SE was involved are covered by your request.
- The request concerns meetings between ATOS and all representatives of DG
Connect, i.e. at political level (Commissioner(s) for DG CONNECT) and at
administrative level (Director General and services)
Based on our analysis at this stage, your application concerns a
significant number of meetings and according to our estimations, a very
large number of documents. Due to the scope of your request, its handling
would involve the entire DG CONNECT and two Commissioners and their
Cabinets (Cabinet Oettinger and Cabinet Gabriel).
The work needed to deal with your application would cover the following
steps:
- Multiple searches for the identification of the documents related to the
meetings which fall with the scope of the request in several document
management systems,
- Retrieval and establishment of a complete list of the documents falling
under the scope of your request,
- Scanning of the documents which are not in pdf format,
- Preliminary individual assessment of the content of the documents in
light of the exceptions contained in Article 4 of Regulation 1049/2001,
- Third party consultations under Article 4(4) of Regulation 1049/2001,
- Final assessment of the documents in light of the comments received,
- Redaction of those parts of the documents to which one or several
exceptions apply,
- Preparation of the draft reply
- Finalisation of the reply at administrative level and formal approval of
the draft decision,
- Preparation of the reply and the documents for dispatch.
It follows from the above that the work needed for the treatment of your
request cannot expected to be completed within the normal time limits set
out in Article 7 of Regulation 1049/2001.
Article 6(3) of the Regulation 1049/2001 provides that, in the event of an
application relating to a very large number of documents, the institution
concerned may confer with the applicant informally with a view to finding
a fair solution. In accordance with the case law of the Union Courts, the
proposal for a fair solution aims to balance the interest of the applicant
against the workload resulting from the processing of the application in
order to safeguard the interests of good administration (Judgments of 6
December 2001, Council v Hautala, Case C 353/99 P, EU:C:2001: 661, para.
30, and of 2 October 2014, Strack v Commission, Case C 127/13 P,
EU:C:2014:2250, para.27). Such solution can only concern the content or
the number of documents applied for, not the deadline for replying
(Judgment of the Court of Justice of 2 October 2014 in case C- 127/13,
Guido Strack v Commission, paragraphs 26-28). This means that the scope of
the request must be reduced in a way that would enable its treatment
within the extended deadline of 15 + 15 working days.
Based on the above, we would kindly ask you to specify the objective of
your request, your specific interest in the requested documents and
whether you could narrow down the scope of your request, so as to reduce
it to a more manageable amount of documents.
According to our first estimates and taking into account the other ‘access
to documents’ requests being handled within DG CONNECT at the same time,
the global workload of the concerned staff during the same period, the
human resources available and the need to safeguard good administration,
we estimate that only a maximum of 20 documents can be dealt with in the
remaining time. We therefore kindly ask you to specify the documents you
are interested.
In order to help you narrow down your wide scope request, please note that
the following categories of meetings have been identified as falling
within the scope of the request:
- Meetings between Commissioners/ DG CONNECT officials and
ATOS SE representatives
- Working Group Meeting on Networking among Digital Innovation
Hubs (DIHs)
- Workshop ‘Common European Data spaces in Smart
Manufacturing’ (16 September 2019)
- Stakeholder forum
- Roundtable ‘Industrial Data Platforms’
- Conference (High Level Conference – Building a Data
Economy)
- European Cybersecurity Organisation meetings
For these meetings, the following categories of documents have been
identified:
- Briefings (approximately 13)
- Minutes/ reports (approximately 15)
- Email exchanges/ Letters related to these meetings
(approximately 14)
- Presentations (approximately 2)
- Agendas / Attendance lists / Programme (approximately 7)
In order to enable us to respect the time limits of Regulation 1049/2001,
we would ask you for a swift response to our proposal for a fair solution
to limit the number of documents to a maximum of 20 documents. Please
respond within three working days at the latest. Please send your response

restrict the scope of your application to those parts that can be dealt
with within the extended deadline of 30 working days counting from the
