Meetings with the Cyber Data Coalition

Dear Justice and Consumers,

Under the right of access to documents in the EU treaties, as developed in Regulation 1049/2001, I am requesting documents which contain the following information:

- a list of lobby meetings held by DG Justice and Consumers with the Cyber Data Coalition (CDC) or its intermediaries (such as Political Intelligence). The list should include: date, individuals attending + organisational affiliation, the issues discussed;
- minutes and other reports of these meetings;
all correspondence (i.e. any emails, correspondence or telephone call notes) between the DG (including the Commissioner and the Cabinet) and CDC or any intermediaries representing its interests.

I am filing the following confirmatory application with regards to my access to documents request 'Impact Assessment of the Commission for the common charger'.

In my request with the reference number 2019/5664 I asked for:
- Documents relating to the Impact Assessment of the Commission for the common charger for phones, including but not limited to the study contracted to Economisti Associati and others on the subject

Today, October 25, I received a reply saying I was granted full or partial access to the document. However, that contains an important caveat. "[T]he main outcomes of the study have not been disclosed, in order not to diffuse preliminary incomplete information, which may be subject to revision in the next phase of the study."

Hence I received several documents including a 166 page pdf containing the draft final report of the Impact Assessment Study on Common Chargers for Portable Devices, but everything except the title page and the table of contents is blackened out.

The reply letter by the Commission makes a reference to article 4 of regulation 1049/2001 on access to documents, but fails to specify what parts of the article specifically it bases its redactions on. I would like to strongly object to the redaction on the grounds of public interest for my work as a journalist. There was no clear reason given for the redaction and I ask for the draft report to be released in full.
