Dear European Food Safety Authority,

Under the right of access to documents in the EU treaties, as developed in Regulation 1049/2001, I am requesting documents which contain the following information:

Since the documents requested via point 6 of recommendation 2017/84 were to be compiled into a single database, we request documents from this database which can answer the following questions:

1. How many Member States have to date (July 15th 2020) delivered any data regarding this monitoring project?
2. How many
a. food business operators,
b. manufacturers,
c. processors and distributors of food contact materials and
d. other interested parties
have to date (July 15th 2020) provided such data (detailed on: number of data sets, type of products / of which product groups, methods used according to the JRC guidelines, levels of detection (LOD), levels of quantification (LOQ))?

3. Which MS have to date (July 15th 2020) provided how many sets of monitoring results (i.e. of how many products tested of which product groups) with which results and at what level of detection (LOD) / level of quantification (LOQ)?

4. Has the COM / EFSA conducted any interlaboratory comparisons? If so, when, how many laboratories from how many MS were involved and what were the results?

5. What types of food have been analysed so far?

Background
On 16 January 2017, the European Commission adopted recommendation 2017/84 for the monitoring of "mineral oil hydrocarbons in foods and materials and articles intended to come into contact with foods". According to this COM recommendation:

“6. Member States, food business operators, manufacturers, processors and distributors of food contact materials and other interested parties should provide to EFSA the monitoring data expressed on whole mass basis with the information and in the electronic reporting format as set out by EFSA for compilation into a single database. They should preferably provide the monitoring data by 1 October 2017 and subsequently by 1 October 2018. The last results should be provided by 28 February 2019.”
In 2019 the Joint Research Centre (JRC), the European Commission’s science and knowledge service has published “Guidance on sampling, analysis and data reporting for the monitoring of mineral oil hydrocarbons in food and food contact materials” - cited below as “JRC guidelines” (https://publications.jrc.ec.europa.eu/re...)

So far none of the results of this monitoring programme have been made publicly available.

Thank you for your email - which was forwarded to us by the

being a request for information - as well as for your interest in the
European Food Safety Authority (EFSA).

 

Analytical results for mineral oil hydrocarbons in foods are collected by
EFSA within the call for continuous collection of chemical contaminants
occurrence data in food and feed (you can find more info [2]here).

 

Most of this data is provided by governmental institutions but data from
academia and private companies might also be available. The European
Commission recently mandated EFSA an opinion on mineral oil hydrocarbons
and this was assigned to the CONTAM Panel. Within this opinion, all
occurrence data available to EFSA will be analyzed and reported. You will
therefore find in this opinion most of information requested, such as,
inter alia, on the data providers, the type of monitoring program and its
legislative framework, details on the analytical methods (e.g. LOD/LOQ,
respect of the JRC guideline, etc.).
