Dear Trade,

Under the right of access to documents in the EU treaties, as developed in Regulation 1049/2001, I am requesting documents which contain the following information:

-all minutes of meetings, and/or any other reports of such meetings, of the SPS Committee of the World Trade Organization (WTO) (between July 28th 2018 and September 1st 2020);

- all minutes of meetings and/or any other reports of such meetings of the TBT Committee of the World Trade Organization (WTO) (between July 28th 2018 and September 1st 2020).

My request focuses specifically on, but is not exclusive to, minutes/reports of meetings where the EU criteria for the identification of endocrine disruptors, endocrine disrupting chemicals (EDCs) in general, the active substance glyphosate, formulated products containing glyphosate, (the setting of) maximum residue levels (MRLs) for pesticides, and/or the EU’s hazard-based cut-off criteria relating pesticides were mentioned/discussed.

European Parliament, Council and Commission documents, your application

has no link with any institution of the European Union. Therefore, the
European Commission cannot be held accountable for any technical issues or

We refer to your access to documents request registered on 15/09/2020
under the above mentioned reference number.

 

Your application is currently being handled. However, due to the character
of the requested documents  we will not be in a position to complete the
handling of your application within the time limit of 15 working days,
which is expiring today.

 

Therefore, we have to extend the time limit with 15 working days in
accordance with Article 7(3) of Regulation (EC) No 1049/2001 regarding
public access to documents. The new time limit is 27/10/2020.

 

Additionally, after having considered the scope of your request as
described by you it appears that your application concerns a number of
very long documents, which need to be assessed individually. Such a
detailed analysis cannot be carried out within the normal time limits set
out in Article 7 of Regulation (EC) No 1049/2001.

 

However, Article 6(3) of Regulation (EC) No 1049/2001 also provides for a
possibility to confer with an applicant informally with a view to finding
a fair solution when an application relates to a very long document or
concerns a very large number of documents.

 

In accordance with the case law of the EU Courts, such a solution can only
concern the content or the number of documents requested, not the deadline
for replying. This means that the scope of the request must be reduced in
a way that would enable its processing within the extended deadline of 15
+ 15 working days.

 

Based on the above-mentioned provision, we would kindly ask you to confirm
that your interests concern exclusively the documents or their parts
related to the following issues (mentioned by you previously in your
request): EU criteria for the identification of endocrine disruptors,
endocrine disrupting chemicals (EDCs) in general, the active substance
glyphosate, formulated products containing glyphosate, (the setting of)
maximum residue levels (MRLs) for pesticides, and/or the EU’s hazard-based
cut-off criteria relating pesticides. In case, the scope of your request
should be enlarged, please specify in a detailed way any additional
subject in your interest.

 

In order to enable us to respect the time-limits of Regulation (EC) No
1049/2001, we would ask you for a swift reply to our invitation to propose
a fair solution, within five working days at the latest.

In the absence of a reply within five working days, we will unilaterally
restrict the scope of your application to those parts that can be dealt
with within the extended deadline of 30 working days,

We refer to our communication from 6/10/2020 , in which we invited you,
pursuant to Article 6(3) of Regulation (EC) No 1049/2001, to propose a
fair solution for dealing with your request for access to documents,
registered on 15/09/2020 under the above-mentioned reference number.

 

We explained that such a fair solution could consist of narrowing down the
scope of your request (i.e. the subject matter(s)), so as to reduce it to
a more manageable amount of documents.

 

We concluded that, according to our first estimates, the documents or
their parts falling within the following scope (communicated with details
by you in your original request) could be dealt with within 30 working
days: the documents or their parts related to the following issues
(mentioned by you previously in your request): EU criteria for the
identification of endocrine disruptors, endocrine disrupting chemicals
(EDCs) in general, the active substance glyphosate, formulated products
containing glyphosate, (the setting of) maximum residue levels (MRLs) for
pesticides, and/or the EU’s hazard-based cut-off criteria relating
pesticides.

Unfortunately you have not replied to our invitation to propose a fair
solution within the requested deadline of 5 working days. We have
therefore, as announced in our communication of 6/10/2020 and taking into
account the specific interest indicated by you, proceeded to the
unilateral restriction of the scope of your application to the documents
or its parts that can be dealt with within 30 working days counting from
the date of registration of your application.

Consequently, your application is understood to cover the documents or
their parts included in two categories indicated below:

-minutes of meetings, and/or any other reports of such meetings, of the
SPS Committee of the World Trade Organization (WTO) (between July 28th
2018 and September 1st 2020);
