Negotiated procedure

We're waiting for Valentina pop to read a recent response and update the status.

Dear European Central Bank,

Under the right of access to documents in the EU treaties, as developed in Regulation 1049/2001, I am requesting documents which contain the following information:

The names of every supplier awarded contracts under negotiated procedures and the associated TED reference numbers for each of those tenders.

Also the sums of the contracts and the reason why these suppliers were awarded through negotiated procedure rather than an open tender.

We regret to inform you that the request referred to in your below e-mail
did not reach the ECB. As you might recall from your previous request for
access to ECB documents, the ECB – as a matter of good administrative
practice – acknowledges receipt of requests without delay. Let us also
draw your attention to the fact that the ECB offers a dedicated e-mail
address and a dedicated form for application for access to ECB documents -

However, further to your e-mail we checked the asktheeu website and
located your request for access dated 14 May 2014.

 

In order to be in a position to address your request for access to
documents in accordance with Decision ECB/2004/3 (the unofficial
consolidated version of this ECB Decision is available on the<[2]ECB
website>), we still require further information. While we understand your
request referring to contracts awarded via public tenders conducted as a
negotiated procedures, we kindly ask you to specify the time period for
which you would like to receive relevant documents.

 

Upon receipt of your response, we will assess your application for access
to documents in line with the provisions of Decision ECB/2004/3.

Thank you for the list and links supplied. However I do notice that there are several contracts missing, such as the ones awarded to Oliver Wyman under negotiated procedure. For example the Framework agreement for Financial Advisory Services concerning the Single Supervisory Mechanism, internal reference number 26133/F/2013, as well as the financial services procurments 24031/M/MOA/2011 and 19051/FS/2011.
Presumably the ECB had several other financial services contracts under negotiated procedure apart from OW? How come they were not listed?

We should like to clarify that our response dated 3 July 2014 addresses
your recent request for access to documents [LS/PvdH/14/28] as further
specified in our email exchange of 11 June 2014.   Accordingly, the ECB
provided you with a list that compiles the contract award notices for
contracts awarded via public tender procedures conducted as negotiated
procedures.

 

The contracts you refer to in your current additional question were
awarded following procurement procedures which, based respectively on
Articles 6(1) and 29 of Decision ECB/2007/5 laying down the Rules on
Procurement, were carried out as competitive negotiated procedures without
publication of a notice. This was also mentioned in our response dated 20
December 2013 [LS/PvdH/13/42] to your previous request for access to
documents that referred to such contracts.

 

Please note that for transparency purposes and as foreseen in Article
30(3) of Decision ECB/2007/5, the ECB publishes annually, on its internet
site, a list of contracts with a value of above EUR 50,000 that were
awarded in accordance with Article 29 or Article 6(1). This list provides
the name of the contractors to whom such contracts were awarded, the
subject and the value of the contracts. For your convenience, we attach
the links to the most recent lists covering the years 2012 and 2013.
