Non-aggregated machine readable EUTL Data

We're waiting for Lars Mai to read recent responses and update the status.

Dear Climate Action,

Under the right of access to documents in the EU treaties, as developed in Regulation 1049/2001, I am requesting documents which contain the following information:

The non-aggregated, machine-readable public data of the EU Transaction Log (EUTL).

The requested data is publicly available on the website of the EUTL:

https://ec.europa.eu/clima/ets/

However, it is not possible to download the complete data set for automated processing. This makes analysis of the data impossible, resulting in lack of transparency in one of the most important EU instruments of climate policy. While it is theoretically possible to download the individual records by hand, this can not be considered "accessible" in current terms.

The EEA publishes aggregated data from the EUTL here:

However, this is aggregated on the country level, and represents only one way of analysis on the underlying data. For example, aggregation and analysis along other dimensions or different geographical segments is not possible. Only by providing the non-aggregated public EUTL data in a machine-readable form, independent analysis is possible and transparency fulfilled.

A request for the EUTL data in machine-readable format has been made in June 2016 (GestDem 2016/3140):

That request was denied, with the reason given that releasing the requested information would violate a) Confidentiality clauses in the Registry Regulation and b) Regulation 1049/2001 (specifically Protection of commercial interest and Privacy of the individual). This reasoning applied because "the full database behind" EUTL and CITL was requested.

My request differs in that regard: only the data that is already publicly available and published on the website according to Annex XIV to the Registry Regulation shall be made available in a machine-readable and non-aggregated form.

It is my understanding that the DG Climate Action is interested in bringing climate action policy closer to citizens, and transparency is an important factor towards that goal. The public data contained in the EUTL is very relevant to that matter, and as such, providing access to that data according to current data management and analysis practices is both furthering that objective, and covered by the existing Registry Regulation.
