Norway drug policy documents at the EMCDDA for 2016 and 2017

Under the right of access to documents in the EU treaties, as developed in Regulation 1049/2001, I am requesting documents which contain the following information:

- All correspondence you have had with Norwegian government representatives in 2017 and 2016.

- All correspondence you have had with Norwegian academics in 2017 and 2016.

- All internal documents (for instance summaries of meetings) relating to Norway and Norwegian drug policy produced in 2016 and 2017.

- All correspondence you have had with representatives of Norwegian antidrug organizations Actis (especially Mina Gerhardsen), Rusmisbrukernes Interesseorganisasjon (RIO), and EURAD (Fay Watson and Mariann Skar) in 2016 and 2017.

Dear Mr Olsen,

I am writing to you regarding your e-mail dated 24 April 2017 in which you
make a request for access to documents, registered on under the
above-mentioned reference number.

As a follow up to Ms Popova’s previous correspondence (below) to you of 4
May 2017 the EMCDDA started to process your request. While doing so, we
have realised that the handling of your request involves the assessment of
numerous documents also originating/involving third parties/Member States.
The analysis of these documents, together with the need to consult the
third parties/Member States concerned in accordance with Article 4(4) and
4(5) of Regulation 1049/2001, cannot be expected to be completed within
the normal time limits set out in Article 7 of Regulation 1049/2001.

 

For this kind of situations, namely when an application relates to a large
number of documents, the above referred Regulation provides for a
possibility to confer with applicants in order to find a fair solution.

 

With regard to the above, we would kindly ask you to clarify/specify the
objective and the actual scope of your request and in particular whether
you could better focus/narrow down this scope (namely as far the subject
matter(s) and/or the timeframe covered), so as to reduce the documents
concerned and the workload required to a more proportional and manageable
amount.

 

If that is not possible, we propose to handle your application in
successive stages, according to groups of documents that can be identified
in accordance with your request and our capacity for handling them. If you
accept this proposal, you could indicate a possible order of priority,
which we would try to follow as much as possible in handling your
application. This means that your application will be handled in
successive stages within the corresponding new time-limits. In this
context you would then receive, at regular intervals, batches of documents
and/or a reasoned reply explaining why some (parts of the) documents
cannot be disclosed.

 

In order to enable us to reply to you as soon as possible, we would
appreciate that you may confirm at your earliest convenience and by return
of e-mail your acceptance of the above presented solution, so that we will
be able to swiftly ensure the necessary follow up.

Shall we assume that in case there was correspondence with the mentioned persons/organisations you are not interested in the administrative correspondence (i.e. hotel reservations, travel arrangements and the like)?

- All correspondence you have had with Norwegian government representatives in 2017 and 2016.
Shall we assume that you intend to receive the correspondence the EMCDDA have had with Norwegian government representatives in its Management Board and Scientific Committee?

- All internal documents (for instance summaries of meetings) relating to Norway and Norwegian drug policy produced in 2016 and 2017.
Shall we assume that your request focus on the Norwegian drug policy specifically and not the meetings covering overall discussions on all EU countries?

- All correspondence you have had with Norwegian academics in 2017 and 2016.

Shall we assume that in case there was correspondence with the mentioned persons/organisations you are not interested in the administrative correspondence (i.e. hotel reservations, travel arrangements and the like)?

Preferably, I would like everything, as from a social constructivist point of view these things can sometimes be important to analyze politically as well.

- All correspondence you have had with Norwegian government representatives in 2017 and 2016.
Shall we assume that you intend to receive the correspondence the EMCDDA have had with Norwegian government representatives in its Management Board and Scientific Committee?

Yes, that sounds reasonable. Is there anything else that might fit the description?

Thank you very much for handling my FOI request in a proper and thorough manner.

Best wishes for a nice summer.

By the way, I believe you should stop cooperating with Actis, as they are working against human rights recommendations from the OHCHR and they promote stigma against drug users and are pro-criminalization. I think you should include the drug user organizations and reform-friendly organizations far more instead. So I hope you won't invite Stig Erik Sørheim anymore to participate.
