* any information (see above) related to the interpretation of Directive 98/34/EC with regards to the notification requirements in the field of copyright.

* any information within the Commission and their staff regarding the ancillary copyright law ("Leistungsschutzrecht für Presseverleger")

* any information concerning the recently closed ECJ case on the notification of the German Leistungsschutzrecht.

Please note that a similar request was filed in 2015 and in 2017. Any document that was fully released in the request GESTEM 2015/3352 or 2017/0859 should be excluded from this request. If a document covered by GESTEM 2015/3352 or 2017/0859 was not or only partially released, I am seeking the full release of said document as the reasons for nondisclosure back in 2015 or 2017 are now gone.

of the European Parliament and of the Council of 30 May 2001 regarding
public access to European Parliament, Council and Commission documents
(hereinafter ‘Regulation 1049/2001’), registered under the above-mentioned
reference number.

 

In your application, you ask for the following documents:

 

“* all information (including but not limited to letters, emails, email

You also request that any documents that were fully released in the
context of GestDems 2015/3352 and 2017/0859 are excluded from the request
and that any documents which were partially released be fully disclosed
given that the reasons for their non-disclosure do not apply anymore.

 

As you were informed, your request was split between DG CONNECT and DG
GROW. DG Connect will handle the last two parts of your request in bold
(the last part will be handled by both DG GROW and DG CNECT).

 

Your application concerns a very large number of documents which need to
be assessed individually. In this regard, reference is made to two past
access to documents requests which you have launched with DG CONNECT with
respect to the same subject matter (GestDem 2016/4441 and GestDem
2018/0811). Within the scope of your present request we have identified
around 93 documents which were previously partially or not disclosed to
you in the context of the two aforementioned GestDem requests. Moreover,
we have also identified a further (more recent) 14 documents which also
fall within the scope of your application. This amounts to a total number
of circa 100 documents falling within the scope of your application.

 

According to our preliminary assessment of the workload estimate involved
in the handling of your request, the handling of all documents falling
under the scope of your request would cover the following steps:

-          Search for possible additional documents falling within the
scope of your request;

-          Retrieval and establishment of a complete list of the documents
falling under the scope of your requests;

-          Assessment of the documents already partially or non-disclosed
in GestDem 2016/4441 and GestDem 2018/0811 with a view to establishing
whether the exceptions used at the time remain applicable;

-          Preliminary individual assessment of the content of the recent
documents in light of the exceptions contained in Article 4 of Regulation
1049/2001;

-          Possible need to consult third parties and other services
within the European Commission on the documents identified;

-          Final assessment of the documents in light of the comments
received;

-          Redaction of those parts of the documents to which one or
several exceptions apply;

-          Preparation and finalisation of the reply for the requests;

-          Preparation of the replies and the documents for dispatch.

 

It follows from the above that the work needed for the treatment of your
request constitutes a severe administrative burden. Furthermore, due to
the wide temporal and material scope of your request, the work cannot be
expected to be completed within the time limits set out in Article 7 of
Regulation 1049/2001.

 

Article 6(3) of the Regulation 1049/2001 provides that, in the event of an
application relating to very large number of documents, the institution
concerned may confer with the applicant informally with a view to finding
a fair solution. In accordance with the case law of the Union Courts, the
proposal for a fair solution aims to balance the interest of the applicant
against the workload resulting from the processing of the application in
order to safeguard the interests of good administration (Judgments of 6
December 2001, Council v Hautala, Case C 353/99 P, EU:C:2001: 661, para.
30, and of 2 October 2014, Strack v Commission, Case C 127/13 P,
EU:C:2014:2250, para.27). Such solution can only concern the content or
the number of documents applied for, not the deadline for replying
(Judgment of the Court of Justice of 2 October 2014 in case C- 127/13,
Guido Strack v Commission, paragraphs 26-28). This means that the scope of
the request must be reduced in a way that would enable its treatment
within the extended deadline of 15 + 15 working days.

 

Based on the above-mentioned provision, we kindly ask you to specify the
objective of your request, your specific interest in the requested
documents (Judgment of the Court of Justice of 2 October 2014 in case
C-127/13, Guido Strack v Commission, paragraph 28; Judgment of the General
Court (then 'Court of First Instance') of 22 May 2012 in case T-344/08,
EnBW Energie Baden-Württemberg v Commission, paragraph 105 ) and to narrow
down the scope of your request, so as to reduce it to a more manageable
amount of documents.

 

If you are not in a position to specify your specific interest in the
requested documents or to propose a limitation of the scope, we propose
that our further assessment against Article 4 of Regulation 1049/2001 is
limited to the following restricted scope:

 

-          10 documents of your choice from the ones which were partially
or non-disclosed in the context of GestDem 2016/4441 and 2018/0811 (please
let us know in case you would require us to send the replies + annexes to
these GestDems once again) and

-          14 more recent documents identified as falling within the scope
of your application and which were not covered by the aforementioned past
GestDems

 

AIso, please note that given that your application concerns a large number
of documents we will not be in a position to complete the handling of your
application within the time limit of 15 working days, which expires today.
Therefore, we have to extend the time limit with 15 working days in
accordance with Article 7(3) of Regulation 1049/2001 regarding public
access to documents. The new time limit expires on 29/10/2019.

In order to enable us to respect the time limits of Regulation 1049/2001,
we would ask you for a swift response to our proposal for a fair solution,
and within three working days at the latest.

With regard to the 14 more recent documents, we take note of your position
and are going to include them in the scope of your request.

Concerning your request for a list of previously undisclosed or partially
released documents in the context of GestDem 2016/4441 and 2018/0811, we
would like to refer you to the previous replies submitted in the context
of the earlier requests and ask you to choose 10 documents out of the
partially or non-disclosed documents. As indicated in our previous email,
we can re-send these replies + annexes if these are no longer accessible
to you.

Concerning your request to indicate which of the documents of the earlier
requests may now be disclosed, we have to inform you that this could only
be done after the assessment and a possible consultation of third parties.
This being said, we believe we can give guidance in so far as it does not
seem likely that the assessment would change concerning the redaction of
personal data. Therefore, you may want to exclude documents  with only
personal data redacted as the personal data exception under Article
4(1)(b) of Regulation 1049/2011 would most likely still be applicable.

Moreover, due to large number of documents which were partially disclosed
(even when already excluding the ones which were disclosed with only
personal data redactions) or non-disclosed in the context of the
aforementioned past requests, we are not in a position to assess all of
them for the present application. We therefore need an indication of the
documents that would be of most interest to you, as indicated in our fair
solution proposal.

We would also like to remind you that we would like to receive a reply
within the three working day timeframe indicated in our fair solution
proposal which expires today. As indicated in our fair solution proposal,
in the absence of a reply we will unilaterally restrict the scope of your
application to those parts which can be dealt with within the extended
deadline. In this case we envisage to  include within the scope the 14
more recent documents and to choose 10 documents from the aforementioned
past requests taking into consideration the date of the documents and the
need to consult third parties for the specific document.

As you were informed on 22 October 2019, the Secretariat General of the
European Commission communicated to the Legal Service your request for
access to documents, under Regulation (EC) No 1049/2001, in order to deal
with documents falling under its responsibility in relation to point 4 of
your application regarding “any information concerning the recently closed
ECJ case on the notification of the German Leistungsschutzrecht.”

 

After research in the Legal Service’s files, it appears that some of the
identified documents originate from third parties, i.e. submissions to the
Court of Justice in Case C-299/17, VG Media.

 

With regard to the documents originating from 3^rd parties, the Commission
has to consult those parties according to Article 4(4) of Regulation (EC)
No 1049/2001, which provides that the institution shall consult the third
parties with a view to assessing whether an exception in paragraph 1 of 2
is applicable. Therefore, the Legal Service will consult them setting a
deadline of 10 working days, in order for them to communicate the
conclusions of their assessments. This consultation period adds an
additional administrative step to the handling of your request.

 

The Legal Service is currently dealing with the part of your request
falling under its competencies. However, in view of the consultation
procedure referred to above, it will not be possible to provide you with a
reply within the extended time limit, which expires on 29 October 2019.

 

We will do our outmost to send you our reply within the shortest time
possible.

(EC) No 1049/2001 regarding public access to European Parliament, Council
and Commission documents ("Regulation (EC) No 1049/2001").

we have not yet been able to gather all the elements needed to carry out a
full analysis of your request and to take a final decision.  Therefore, we
are not in a position to reply to your confirmatory request within the

The Commission’s Legal Service refers to your request for access to
documents, under Regulation (EC) No 1049/2001, concerning the notification
requirements of the German ancillary copyright law as well as the Spanish
ancillary copyright law, registered under reference GestDem 2019/6767.

 

Your application is currently being handled. However, in view of the large
number and nature of the requests for access to documents the Legal
Service is presently dealing with, we have not been in a position to
complete the processing of your application within the time limit of 15
working days, which expires today, the 9^th of December 2019.

 

For this reason, we have to ask for an extension of the time limit by 15
working days, in accordance with Article 7(3) of Regulation (EC) No
1049/2001. The new deadline expires on 09/01/2020. Please be assured that
we will do our utmost to send you the reply in the shortest time possible.

 

At the same time, we will like to inform you that the Legal Service is

documents relating to Case C-299/17. Please note that some consultations

I refer to your e-mail of 24 January 2020, registered on the same day, by
which you submit a confirmatory application in accordance with Article
7(2) of Regulation (EC) No 1049/2001 regarding public access to European
Parliament, Council and Commission documents (hereafter ‘Regulation (EC)
No 1049/2001’).

 

I also refer to our holding reply of 14 February 2020, by which the time
limit for replying to your confirmatory application was extended by 15
working days, pursuant to Article 8(2) of Regulation (EC) No 1049/2001.

 

I regret to have to inform you that we will not be able to respond within
the extended time limit, which expires on 6 March 2020, as we have not yet
finalised internal consultations. However, I can assure you that we are
doing our utmost to conclude these consultations and provide you with a
final reply as soon as possible.

 

I regret this additional delay and sincerely apologise for any
inconvenience this may cause.

On 16 November 2019 you submitted a confirmatory request for access to
documents, registered under reference number GETSDEM 2019/5319.
Specifically, you asked for a review of the position of the
Directorate-General for Communications Network, Content and Technology,
responsible at initial stage for your application for the following
documents, I quote:

 

-        ‘[..] any information within the Commission and their staff
regarding the ancillary copyright law ("Leistungsschutzrecht für
Presseverleger");

-        any information concerning the recently closed ECJ case on the
notification of the German Leistungsschutzrecht’ [jointly responsible with
the Legal service of the European Commission].

 

Please note that among the identified documents at initial stage,
documents 1 and 3 contain your own personal data. You submitted your
request via AsktheEU.org website. The third party running that website
usually publishes the content of applicants’ correspondence with the
European Commission on the web platform, including the documents disclosed
in the framework of their requests. This includes the personal data that
applicants may have communicated to the European Commission.

 

Please note that, since two of the identified documents in the framework
