* all information (including letters, emails, documents, notes, memoranda, studies, remarks, copies, data, files, facsimiles, drafts and records) about the notification under Directive 98/34/EC related to the German Presseverlegerleistungsschutzrecht (Achtes Gesetz zur Änderung des Urheberrechtsgesetzes dated May 7, 2013 (BGBl 2013 I Nr. 23 ,pg 1161)
This includes information related to the letter sent from the Commission (DG Enterprise and Industry) Unit C3 on February 27 2013 to Germany and any prior and subsequent information.

Thank you for providing us the requested postal address. Concerning the reason for this requirement please find our explanations below.
On 1 April 2014, the postal address became a mandatory feature for the purpose of introducing a request for access to documents.
The decision to ask for a postal address from applicants for access to documents was triggered by the following considerations:
• The need to obtain legal certainty as regards the date of receipt of the reply by the applicant under Regulation 1049/2001. Indeed, as foreseen by Article 297 of the Treaty on the Functioning of the European Union (TFEU), […] decisions which specify to whom they are addressed, shall be notified to those to whom they are addressed and shall take effect upon such notification. Replies triggering the possibility for administrative or judicial redress are therefore transmitted via registered mail with acknowledgement of receipt. This requires an indication of a valid postal address by the applicant;
• The need to direct the Commission's scarce resources first of all to those requests which have been filed by "real" applicants. With only a compulsory indication of an e-mail address, applicants can easily introduce requests under an invented identity or under the identity of a third person. Asking for a postal address helps the Commission to protect the administration, as well as other citizens and legal persons, from abuse;
• For similar reasons, asking for a compulsory indication of a postal address enables the Commission services to verify whether Article 6(3) of the Regulation, on voluminous requests, is being evaded by introducing several requests under different identities. Indeed, in its Ryanair judgment, the General Court confirmed that Article 6(3) cannot be evaded by splitting the application into a number of applications. The Commission would like to point out that, in 2012/2013, it received some 57 confirmatory requests from what it suspects to be one single applicant operating under 13 different identities;
• Knowing whether the applicant is an EU resident in the sense of Article 2(1) of Regulation 1049/2001 is a precondition for the purpose of correctly applying the exception in Article 4(1)(b) of Regulation 1049/2001 (protection of the privacy and integrity of the individual), which has to be interpreted in accordance with Data Protection Regulation 45/2001. Article 9 of Regulation 45/2001 requires the adequacy of the level of protection afforded by the third country or international organisation when transmitting personal data to third-country residents or legal persons. It follows that, in case of requests for documents which include personal data, the correct application of the data protection rules cannot be ensured in the absence of a postal address enabling the Commission to ascertain that the minimum data protection standards will be respected.
All of these considerations show that the request for and the consequent processing of a postal address is not only appropriate but also strictly necessary for the performance of a task carried out in the public interest within the meaning of Article 5 (a) of Data Protection Regulation 45/2001, namely providing a smooth and effective access to documents.

Article 7 (3) of the Regulation (EC) No 1049/2001 allows for the extension of the time-limit by 15 working days if several conditions are met.
You have not provided sufficient information that this is an exceptional case as required by Article 7 (3), you have not provided detailed reasons also required by Article 7 (3) of the Regulation.
You are requested to disclose the identity of the third party requesting the disclosure of my identity and any document related to this. Please indicate whether you are asking for a separate document request to be filed for this information or if it can be handled within this document request.
Regulation (EC) No 1049/2001 does not allow the disclosure of my identity in document requests to third parties. Article 6 (1), sentence 2 of the Regulation states that the applicant is not obliged to state reasons for the application, hence the identity of the applicant is irrelevant to the document request outside of the conditions of Article 2, as the request for identity disclosure by this third party is an attempt to circumvent Article 6 (1).
Given the time limit set in Article 7 and with regards to Article 7 (4) of the Regulation, please acknowledge my request for a confirmatory application by the end of this day in case of failure to reply to my document request.

The reasons for the extension of the time limit with 15 working days have been stated in the holding reply sent to you earlier today. According to Article 7(3) of Regulation n.1049/2001, in exceptional cases, for complex requests, for instance those which involve numerous documents and/or concern consultation of third parties, the time limit can be extended by 15 working days. In the case of your request, some of the documents you have requested originates from third parties who have to be consulted.
Please be reassured that your identity is not going to be disclosed without your consent. The aim of our previous message was precisely to ask you whether you agree or not to the disclosure of your identity, without any obligation for you to provide information relating to it. In this respect, we would like to inform you that the Commission applies a policy of protection of personal data towards all the third parties. Therefore, we cannot disclose the name of the third party who has asked about your own identity.
According to article 7(2) and to article 7(4) a confirmatory application can be made respectively in case of total or partial refusal of access to a document or of failure to reply within the prescribed time limit. This is not the case here, as we are doing our best to reply to your request within the time limits prescribed by Regulation 1049/2001.

Dear Unit A5,
in your letter, you state "In this respect, we would like to inform you that the Commission applies a policy of protection of personal data towards all the third parties. Therefore, we cannot disclose the name of the third party who has asked about your own identity.".
Am I correct to assume this third party has not been asked for consent to disclose their identity?
Both of your mails from today lack any information why a consultation with a third party renders this request "exceptional" to invoke extension of the time-limit.
In the interest of a speedy process, you are invited to submit all documents that do not need third party consultation as a partial delivery as there is no reason for an overly broad application of the the time-limit exceptions for those documents.
