Dear Competition,
Under the right of access to documents in the EU treaties, as developed in Regulation 1049/2001, I am requesting documents which contain the following information:
- Any documentation referring to OpenAI or ChatGPT. This documentation should include but not be limited to: general communications of any nature, written material of any kind, consultation notes, email correspondences, attendance lists, agendas, background papers, briefing papers, transcriptions of meetings, readouts of meetings, summaries of meetings, briefings for meetings, etc.

Hello,
We are writing concerning your request for access to Commission documents
registered on 31/05/2023 under case number 2023/3136.
We are currently working on your request. However, we have not yet been
able to gather all the elements necessary to carry out a full analysis of
your request. We will not be able to send you the reply within the
prescribed time limit expiring on 21/06/2023.
• the application concerns documents held by different Services, which
must be consulted.
Therefore, in line with Article 7(3) of [1]Regulation (EC) No 1049/2001,
we need to extend this time limit by 15 additional working days. The new
time limit expires on 12/07/2023.

I am filing the following confirmatory application with regards to my access to documents request 'Open AI / Chat GPT'.
The response I received refuses to disclose any documentation on Chat GPT or Open AI on two grounds.
One of those grounds is Article 4(2) of Regulation 1049/2001 - third indent, protection of the purpose of investigations.
In the letter, the Commission states that: "the prevailing interest in this case lies in protecting the effectiveness of the Commission’s merger investigations."
However there is no merger investigation involving Open AI listed on the Commission's merger case website.
As such, using this particular article of Regulation is 1049/2001 to refuse to disclose documents pertaining to the above companies is insufficient and requires an internal review.
