I am filing the following confirmatory application with regards to my access to documents request 'Organic farming regulation', which was registered on 03/11/2017 under reference number GestDem 2017/6695.

In the Commission's reply dated 19/12/2017, Mr Jerzy Plewa writes that of the 88 documents that have been identified, only three could be made public (one had already been made public).

The reason given is that the proposed legislation has not yet been voted on in parliament and council.

“As long as the inter-institutional decision-making process has not been finalised, disclosure to the public of the preliminary views and the positions expressed in the trilogue meetings by the representatives from the Commission, the Council and the Parliament would entail a reasonably foreseeable and specific risk of putting the inter-institutional decision-making process under external pressure, thereby jeopardising the compromises reached.”

However, this stance poses considerable problems for European democracy. It would mean that the decision-making process would only become public after the proposed regulation has already been adopted.

If citizens, potentially via media, are not able to know the steps leading up to the final compromise text, they are not well-informed enough to tell their MEPs or national governments representing them in the Council whether they would like the legislative proposal to be supported. This could seriously undermine their potential to influence policy-making.

“In exceptional cases, for example in the event of an application relating to a very long document or to a very large number of documents, the time-limit provided for in paragraph 1 may be extended by 15 working days, provided that the applicant is notified in advance and that detailed reasons are given”

From this follows that missing the extended deadline would only arise in circumstances that are even more exceptional than exceptional cases, as well as be substantiated by detailed reasons.

In my humble opinion, the justification of the Commission 'not yet having finalised internal consultations' does not qualify as 'detailed reasons'. I would appreciate if you could elaborate and explain why the exceptionally long period to respond to my confirmatory application is needed.

Further to your email below, I would like to clarify the detailed reasons
for the delay pertaining to the handling of your confirmatory application.

 

As stated in our email of 19 February 2018, we have not yet finalised
internal consultations in relation to your confirmatory application. This
is due to the following reasons.

 

Your request concerns not only a very large number of documents (namely
84), but also very voluminous ones. As explained in the initial reply of
19 December 2017 sent by the Directorate-General for Agriculture and Rural
Development (DG AGRI), some of the documents are 600 pages long.

 

The 50 fully refused documents (consisting of agendas and non-papers) and
the refused parts of the 34 four column tables (namely their fourth
column) must be assessed under the exception of Article 4(3), first
subparagraph of Regulation 1049/2001.

 

Such assessment is quite complex as:

 

- the issue of the public disclosure of trilogue-related documents
concerns all three Institutions which must adopt a consistent position;

- the transparency of Trilogues has already been the subject of an
Ombudsman decision following her strategic inquiry OI/8/2015/JAS; and

- it is at the core of a pending Court case, namely the De Capitani v
European Parliament case (registered under Reference T-540/15).

 

Against this background, we had to inform you on 19 February 2018 that we
would not be able to respond within the extended time-limit provided for
the handling of your confirmatory application.

 

I would like hereby to reassure you that we are doing our utmost to
provide you with a final reply as soon as possible.

 

I sincerely regret the additional delay and apologise for any
inconvenience this may cause. I thank you very much in advance for your
