Penalties notification regulation (EU) 2015/2283

- A list of which member states have notified by 1 January 2018 the European Commission on the implementation of the provisions on penalties, as required by article 29 of regulation (EU) 2015/2283 of 25 November 2015

- The content of all member states' notifications of the provisions on penalties, as required by article 29 of regulation (EU) 2015/2283 of 25 November 2015.

- The content of any communication from the European Commission to member states about the provisions on penalties from article 29 of the same regulation.

PS: I have noticed that the Commission sometimes send both a digital and a paper version by registered mail of your response. Please only send paper versions of your communication if you do not intend to send a digital copy. The physical mail always reaches me later than e-mail, so paper versions are environmentally wasteful and somewhat inefficient.

Thanks for your reply to my request. Unfortunately, the xls-document refers to pdf's which are not attached. They refer to a computer location U:\NOVEL FOOD\IMPLEMENTATION\ rather than to an internet link.

Could you send the pdf's separately?

Dear Madam, Sir,

I would like to come back to the response you gave me to my access to documents request title 'Penalties notification regulation (EU) 2015/2283'. After having read the documents (and having published an article about it - https://euobserver.com/health/141248) I realised that DG SANTE has taken a positive approach to answering to my request.

You could have, like other DG's have in the past when I asked them about penalty notifications, simply said that by 1 January 2018 the Commission had received nothing, and that's that. Instead, you used the time you had to reply by reaching out to the member states and reminding them of their obligation to notify the Commission. And quite successfully.

By doing this, I think you went beyond the legal obligations under the EU's access to documents request, which normally only applies to information that already 'exists' in the form of documents. This proactive approach, which is perhaps more in line with the spirit of transparency than the alternative route you could have taken, is commendable.

For that, I'd like to offer my sincere thanks.
