PMI anti-contraband and anti-counterfeit agreement

Dear European Anti-Fraud Office,

Under the right of access to documents in the EU treaties, as developed in Regulation 1049/2001, I am requesting documents which contain the following information:

1. All correspondence between Member States and the European Commission over the last year relating to the anti-contraband and anti-counterfeit agreement reached with PMI in July 2004 and most specifically, correspondence relating to the decision on whether or not to renew this agreement.

2. Any unpublished evaluations of the effectiveness of this agreement.

Dear EC ARES NOREPLY,

I am concerned that my request is now long overdue. By law, under all circumstances, you should have responded by now. My request concerns an important issue that the public need to know about. I also note that the Commission's response to the recent EU Ombudsman's recent investigation into Article 5.3 of the Framework Convention on Tobacco Control stated that the Commission is transparent and thereby complies with Article 5.3 because it complies with 1049 requests. Yet in this case, you are not compliant.

Dear European Anti-Fraud Office,

Please pass this on to the person who conducts Freedom of Information reviews.

I am writing to request an internal review of European Anti-Fraud Office's handling of my FOI request 'PMI anti-contraband and anti-counterfeit agreement'.

The request was made on 1st February for:
1.All correspondence between Member States and the European
Commission over the last year relating to the anti-contraband and
anti-counterfeit agreement reached with PMI in July 2004 and most
specifically, correspondence relating to the decision on whether or
not to renew this agreement.
2. Any unpublished evaluations of the effectiveness of this
agreement.

On 22nd February OLAF informed me that they could not complete handling of the application within the 15 day limit.

On 15th March I requested a response and I have still not heard back. I would be grateful if you could look into the matter. This is a topic of major public interest and the delay is unjustified.
