Dear Permanent Representation of Poland to the EU,

I would like to kindly request you, pursuant to Art. 2 clause 1 of 6 September 2001 of the Act on Access to Public Information (Journal of Laws 2001, No. 112, item 1198), for the Permanent Representation of the Republic of Poland to the European Union to provide public information on the number of meetings during the last 12 months, employees of the Representation with representatives of companies, organizations or other stakeholders (in particular with persons conducting broadly understood professional and non-professional lobbying activities). Along with the number of indicated meetings, I would like to ask you to prepare information about who participated in each of these meetings (both on the part of the Representation and other entities), when the meeting took place and what was its subject.

In order to enable the implementation of this application, I consent to the processing of my personal data in accordance with the Act of August 29, 1997 on the protection of personal data (ie Journal of Laws No. 101 of 2002, item 926).

In response to the request submitted by e-mail on 8 July 2021 to the
Permanent Representation of the Republic of Poland to the European Union
for access to public information concerning the meetings of employees of
the Representation with representatives of companies, organizations or
other stakeholders during the last 12 months I would like to inform you of
the following.

 

The Permanent Representation does not keep a separate register of the
meetings of the Permanent Representation’s employees with representatives
of interest groups. According to the Polish legislation and internal
organizational regulations there is no such legal obligation. Moreover,
according to the case-law of the national administrative courts (e.g. the
judgment of Voivodship Administrative Court in Warsaw of 21 August 2019,
no II SA/Wa 718/19 and of National Administrative Court of 18 June 2019 r.
no I OSK 2893/18) the public authorities are not obliged to grant access
to the information concerning meetings of their employees since this
information is not treated as public information pursuant to the Act on
Access to Public Information (Journal of Laws 2020.2176).

 

However, in response to your request, we searched the calendar of
meetings of the Permanent Representative of the Republic of Poland to the
European Union and the Deputy Permanent Representative. Please find below
the list of the meetings included in our calendar:

9 October 2020   – Permanent Representative, Mr Andrzej Sadoœ met with the
board of directors of the American Chamber of Commerce to the European
Union (AmCham);

4 February 2021 – Deputy Permanent Representative, Mr Arkadiusz Pluciñski
met with the director of Government Relations IP Europe and  the Executive
Director of Eamonn Bates Europe;

9 February 2021 – Deputy Permanent Representative, Mr Arkadiusz Pluciñski
met with the Secretary General of Hydrogen Europe;

25 February 2021 – Deputy Permanent Representative, Mr Arkadiusz Pluciñski
met with the Executive Director of Central Europe Energy Partners (CEEP).

In response to your further request submitted by e-mail on 20 July 2021 to
the Permanent Representation of the Republic of Poland to the European
Union for access to public information concerning the meetings of the
Permanent Representative of the Republic of Poland to the European Union
and the Deputy Permanent Representative, I would like to inform you that
the notes of meetings of public authorities are internal information and
as such they do not constitute the public information (e.g. the judgment
of Voivodship Administrative Court in Warsaw of 7 November 2019, no II
SAB/Wa 569/19). However, in response to your request, we would like to
inform you that the meeting of 9^th October 2020 concerned the economic
relations with the United States while the meetings in February concerned
then-present initiatives remaining under the remit of COREPER I within the
field of energy.
