Dear European Data Protection Board,

Under the right of access to documents in the EU treaties, as developed in Regulation 1049/2001, I am requesting documents which contain the following information:

Proposals from individual EU data protection supervisory authorities sent to the EDPB in the context of, i.e. before, the preparation and publication of WorkingPaper 248. Example: Proposal for a list according to Art. 35 (4) GDPR by the data protection supervisory authority Poland or Germany to the EDPB before WorkingPaper 248 was adopted.

When you refer to the " WorkingPaper 248", do we understand correctly that
you are referring to the working paper 248 adopted by the Article 29
Working Party?

 

If this is the case, please note that the Secretariat of the Article 29
Working Party was provided by DG JUST of the European Commission. As such,
the EDPB does not, in principle, hold any documents produced prior to its
establishment on 25 May 2018, unless these were shared with the EDPB. The
archived documents adopted by the Article 29 Working Party (1997-2016) are
available on the website of the European Commission here: [1]WP29 archive,
documents adopted after this and prior to the establishment of the EDPB
are available here: [2]2016-2018. Furthermore, information on how to
access documents of the European Commission can be found here:
