I am filing the following confirmatory application with regards to my access to documents request 'Request to the EU-Gambia Good Practices Procedures on Identification and Return - May 2018'.

Your answer, dated 14 April 2021, underline how the disclosure of the document is covered by the exception to the right of access laid down in Article 4(1)(a), third indent, of Regulation 1049/2001 and cannot be disclosed.

I’m asking a review of my request, as I consider that this exception cannot applied to the document requested, in force of the following argumentation:

In 2018, the EU and The Gambia signed an agreement called “Good Practices document on identification and return procedures”.

On the Gambian Government’s request the EU agreed postponing the start of implementation until 16 November 2018.

An increase in Gambian deportations began in November 2018 after the EU and the government agreed on a ‘good practice’ agreement for efficient return procedures.

In February 2019 the Gambian government lifted a moratorium on forced return operation from Europe.

In February 2020 an agreement was finally reached on detailed modalities for future non-scheduled flights from the EU with an incremental approach to number of returnees and number of flights. One successful return operation took place before COVID-19 restrictions brought return operations to a halt.

While engaging in the field of forced return from Europe, the EU Commission put a lot of efforts and financial resources from the EUTFA to ensure a dignified return and reintegration for the Gambian citizens forcely returned from Europe.

One project - 3.9 mln Euro - was approved in 2017 and a second one - 23 mln - started in May 2018 (the very same month of the signature of the agreement)

On the base of the argumentation proposed:

The “Good Practices document on identification and return procedures” between EU and Gambia must be considered as international agreement, thus shall be published in the Official Journal, following art 13, para 1, of Reg. 1049/2001: “In addition to the acts referred to in Article 254(1) and (2) of the EC Treaty and the first paragraph of Article 163 of the Euratom Treaty, the following documents shall, subject to Articles 4 and 9 of this Regulation: [...] International agreements concluded by the Community or in accordance with Article 24 of the EUTreaty”

The legal framework of the 2018 “Good Practices document on identification and return procedures” in the context of bilateral agreements is fully in line with the general provisions of public international law and the 1969 Vienna Convention on the Law of Treaties. As is well known, what describes the nature of the international treaty is its substance and, in particular, its capacity to create binding legal situations under international law between legal entities having legal capacity under international law

In fact, in addition to their purely operational nature, the “Good Practices” also have a political content that not only establishes binding legal obligations between the parties - consider for example the need of the Gambian government to suspend the returns by lifting a moratorium - but also provides the legal basis for carrying out EU readmissions to The Gambia (as demonstrated by the increase return flights after the 2018 agreement on readmission, and the resumption of returns flight in February 2020 after further engagement of EU and re-entry into force of the agreement on “Good Practice”.) Moreover, following the principle of freedom of form laid down in Article 11 of the Vienna Convention, treaties may be concluded in the form of an agreement, treaty, memorandum , protocol, convention, statute, etc.

Finally it must be noted that, in accordance with Articles 28(1) and 41(1) of the EU Treaty, the right of access also applies to documents relating to the common foreign and security policy and to police and judicial cooperation in criminal matters.
In fact, following art 4, para 6 Reg. 1049/2001 “If only parts of the requested document are covered by any of the exceptions, the remaining parts of the document shall be released”.
