Under the right of access to documents in the EU treaties, as developed in Regulation 1049/2001, I am requesting the following documents:

- The responses you obtained from the EU Member States with regards to whether or not they agreed to share documents related to the work of the Code of Conduct Group on Business Taxation with the European Parliament. Apparently, 14 responses were positive and the other 14 expressed reservations of some kind, but I would like to receive a copy of these responses in order to know which Member State said what.

Dear Madam,

We refer to your request dated 14/10/2015 in which you make a request for access to documents, registered on 19/10/2015 under the above mentioned reference number.

Your application is currently being handled. However, we will not be in a position to complete the handling of your application within the time limit of 15 working days, which expires on 10/11/2015.

An extended time limit for consultations with the Member States is needed in order to complete our assessment on the possibility for the public disclosure of the document requested.

Therefore, we have to extend the time limit with 15 working days in accordance with Article 7(3) of Regulation (EC) No 1049/2001 regarding public access to documents. The new time limit expires on 01/12/2015.

We apologize for this delay and for any inconvenience this may cause.

Many thanks for your reply. I would like to clarify my request first of all.

I was requesting access to the full set of correspondence between the European Commission and Member States concerning the access by the European Parliament to the Code of Conduct documents. The documents provided correspond to the proposed reading room arrangement, but I was actually requesting the initial correspondence, which took place in June and over the summer.

Many of the documents provided by you refer also to a "scanned version of the above-mentioned note signed by Heinz Zourek", and references are also made to documents Ares(2015)3944188 and Ares(2015)4413083 which were not included in your response to my request.

Other correspondence received refers to attachments which were not included in your response. For example:
- The response from the Permanent Representation of Romania states "Please find enclosed the reply from Ministry of Public Finance."

Other correspondence also refers to posterior communications, for example the Spanish response states "therefore we kindly ask you for some more time to respond your answer about the examination of these documents." Was any further response received?

I take note of the refusal to provide access to the responses from the UK and Italy but will first await your clarification before considering a confirmatory application.

In that request, you clearly referred to responses received and in view of the figures you referred to, it was understood that you requested access to the replies further to the consultation of Member States in last September.
Please accept our apologies for the annexes to the replies which were not provided. You will find them attached.
Regarding the Spanish reply, you were provided with the only reply we received.

At this stage, we understand that you are also interested in other documents related to the correspondence between the European Commission and Member States concerning the access by the European Parliament to the Code of Conduct documents.
We therefore invite you to submit a new request for access to the specific documents your are interested in.
