Return operations of migrants
Dear European Border and Coast Guard Agency,
Under the right of access to documents in the EU treaties, as developed in Regulation 1049/2001, I am requesting documents which contain the following information:
A list of all chartered return operations of migrants conducted or coordinated by Frontex between August 2019 and July 2020, specifying for each operation the following:
- Date.
- Country or countries (EU or not) participating in the operation.
- Country from where the migrants were returned.
- Destination.
- Number of migrants returned, specifying also their nationality, age and gender.

This is starting to look like a couple's spat. I've once again used (copypasted) the credentials you sent me, and still it says "invalid token data provided". The only possible problem I see is with the e-mail address. Could you confirm the one I have to use is the one I use to log in AsktheEU.org? If that's the case, please, provide a different way to access your reply.

As regards the credentials provided by Frontex their functionality has been verified. Kindly note that Frontex is not in a position to confirm credentials provided by the media used by applicants to submit applications and cannot be held liable for deficiencies of the media used by applicants to submit applications.

I have indeed finally been able to access the correspondence. However, I would like to ask you to respond to my request via AskthEU.org.
Please take into account the Decision in case 104/2020/EWM of the European Ombudsman (https://www.ombudsman.europa.eu/en/decis...), which stated the following:
“When responding to a request for access, the rules oblige an institution to provide access only to the applicant, that is, the person who has asked for the document. It is not obliged to publish the document or disclose it to the world at large. Nevertheless, the institution should always take steps to fulfil its obligation to give the fullest possible effect to the right of access and take into account the public interest in the wider disclosure of documents requested. Fulfilling requests via online portals is an effective means of complying with this obligation. Where an applicant has specifically stated that this is their preferred medium for receiving the response to their request and any documents to which public access is granted, institutions should comply with that request unless there is very good reason (which should be explained) for them not to do so. This is a matter of good administration as well as a means of complying with the legal obligation to give the widest possible public access”.
AsktheEU.org is my "preferred medium for receiving the response" - so please, in case you choose to use any other medium to answer to my request, proceed to explain that "very good reason".

In regard to your reference to the European Ombudsman Decision in case “104/2020/EWM”, please be informed that decisions of the European Ombudsman are not legally binding erga omnes. Notwithstanding, the procedure you referred to pertains to the submission of applications and the medium to which Frontex replies. The Transparency Office is currently processing your application and has complied with your request regarding your preferred reply address which is [FOI #8336 email] .
