Information note on data processing and confidentiality

Data processing

Complaints to the Ombudsman and related correspondence often contain
personal data, such as names, contact details and other information
relating to identifiable individuals.

There are rights and obligations under European law (Regulation
2018/1725)[1] as to how personal data is handled by EU institutions,
including the European Ombudsman. These include an individual’s right to
obtain access to his or her own information held by this Office. To
exercise these rights or to find out more, please contact our
[2]Office or our [3]Data Protection Officer.

If a person considers that the Ombudsman has not handled his or her
personal data properly, he or she may contact the [4]European Data
Protection Supervisor.

Confidentiality of your complaint and information

Complainants are requested to identify clearly any document or
information that they consider to be confidential immediately on sending
it to the Ombudsman.

Confidentiality can only apply if there would be some adverse effect if
the information were to be disclosed. It might, for example, apply to
financial information, commercially sensitive information or personal
information about a private individual. Confidentiality cannot always be
guaranteed. In particular, if you submit to the Ombudsman documents that
contain the personal data of someone other than yourself, that person
will most likely be able to obtain it from the Ombudsman, exercising
their data protection rights. In any event, you should expect your
complaint and any supporting documents to be shared in full with the
institution or body you are complaining about, so that they can properly
understand it and respond to the Ombudsman.

to documents concerning a logistics company

Commission about its failure to reply in time to your request for public

Dear Ms Precedenti,

The Commission has informed us that it will not be able to reply to your
access to documents request by 20 June 2022. The Commission has indicated
that it will reply by 20 July 2022.

We noticed that the Commission informed you via the AsktheEU
website,[1][1] on 9 June 2022, that it was not aware of your initial
request of December 2021. The Commission also told you that it is now
dealing with your request and will send you a reply on the substance soon.

In line with the [2]EU legislation on public access to documents, once the
Commission has registered the request, which we understand it has done
now, it should provide you with an initial reply within 15 working days,
or within 30 working days if it provides a justification for extending the
deadline by 15 working days.

We will come back to you as soon as there are any new developments on your
complaint.

Decision on the European Commission's failure to reply to a request for
public access to documents concerning a logistics company

 

Dear Ms Precedenti,

You submitted a complaint to the European Ombudsman about the European
Commission’s failure to reply in time to your request for public access to
documents, done via the AsktheEU website.[1]^^[1]

We informed the Commission of your complaint and asked it to send you a
reply. The Commission has informed us that it has done so in the meantime.

The case is therefore closed with the conclusion that it has been settled.

Please note that this inquiry concerned exclusively the Commission’s
failure to reply to your application for access to documents. If you do
not consider that the documents provided by the Commission satisfy your
request and you therefore wish to pursue the matter, you can submit a
confirmatory application with the Commission.[2]^^[2] Please note that a
confirmatory application must be made within 15 working days of receiving
the institution's reply. In the event that Commission does not respond
within the relevant deadline[3]^^[3], or that you are dissatisfied with
its response, you may make a new complaint to the Ombudsman. There is no
need to resubmit the documents already included in your file. A reference
to the present complaint number will suffice.
