for access to documents, registered at INEA under the above mentioned
reference number.

Your application is currently being handled. However, we will not be in a
position to complete the handling of your application within the time
limit of 15 working days, which expires on 04/07/2018.

An extended time limit is needed as part of the documents requested
originate from third party which has been consulted.

Having examined the documents requested under the provisions of Regulation
(EC) No 1049/2001 regarding public access to documents, INEA has come to
the conclusion that :

 

1.       The following documents may be disclosed:

§  annexes 4, 5 and 6 to the GA ( Annex 4 –Model Financial statement,
Annex 5- Model for the certificate on the financial statements, Annex 6 –
Model for the certificate on the methodology), notifications on the
revised version of H2020 Model Grant agreement, some of the deliverables
(Steelanol Flyer and Poster), Publishable summary reports

 

2.       The following documents may be partially disclosed:

§  Invitation letter including the information out of ranking, Exchange of
emails regarding the preparation of the grant agreement, Grant Agreement,
Information letter for Interim payments, Notification for review meeting,

 

These documents  may be partially disclosed, some parts of the documents
have been blanked out as their disclosure is prevented by exceptions to
the right of access laid down in Article 4 of this Regulation. The
documents requested contain personal data which have been expunged.
Disclosure of these parts is prevented by the provisions of  Article
4(1)(b) of this Regulation (protection of privacy and the integrity of the
individual of Regulation 1049/2001). The other parts of the documents that
were redacted contain commercially sensitive business information of the
beneficiaries. Disclosure of these parts is prevented by the provisions of
Article 4(2) first indent of the Regulation.

 

3.       The following documents may not be disclosed :

§  Proposal, Evaluation Summary, Ethics reviews, Grant declarations, Annex
1 to the GA - Description of Action , Annex 2 to the GA –estimated budget
of the action, Annex 3 –Accession Forms, Documents included in the
Periodic reports (except publishable summary reports) and deliverables
(except for Deliverable 29- Leaflets and posters), Suspension of the
payment deadline, Internal reports for the assessment of the project

 

 

These documents are commercially sensitive and may not be disclosed based
on the exception of  Article 4(2) first indent of the Regulation. Their
disclosure would seriously undermine the protection of commercial
interests of the beneficiaries, including their intellectual property
rights. The public interest has not been demonstrated, in our opinion.

The disclosure of the internal reports such as Evaluation Summary Report,
Internal reports for the assessment of the project is refused as we came
to the conclusion that  they contain opinions for internal use as part of
deliberations and preliminary consultations within the institution
concerned. Their disclosure would seriously undermine the institution's
decision-making process, even after the decision has been taken, unless
there is an overriding public interest in disclosure(Article 4.3 of
Regulation 1049/2001). The public interest has not been demonstrated, in
our opinion.

 

In accordance with Article 7(2) of Regulation 1049/2001, you are entitled
to make a confirmatory application requesting the Agency to review this
position.

 

Such a confirmatory application should be addressed within 15 working days
upon receipt of this email to the Director of INEA at the following

Thank you for handling my access to documents request, which was registered on 13/6/2018 under reference number GestDem 2018/3201.

However, I would like to ask for a review of the decision not to disclose the following documents: § Proposal, Evaluation Summary, Ethics reviews, Grant declarations, Annex 1 to the GA - Description of Action , Annex 2 to the GA –estimated budget of the action, Annex 3 –Accession Forms, Documents included in the Periodic reports (except publishable summary reports) and deliverables (except for Deliverable 29- Leaflets and posters), Suspension of the payment deadline, Internal reports for the assessment of the project

The project which is being funded aims to recycle carbon emissions into sustainable, advanced bio-ethanol. It could help reduce climate change which can have profound effect on EU citizens' lifes, but also could have unintended negative environmental consequences. The success or failure and content of this project is therefore of great public interest. In addition, the project is being funded from the EU budget, meaning that EU taxpayer money will be involved.

Additionally, the Aarhus Convention may apply. The 1998 treaty says that everyone has the right to receive environmental information, the definition of which includes article 3(b): “Factors, such as substances, energy, noise and radiation, and activities or measures, including administrative measures, environmental agreements, policies, legislation, plans and programmes, affecting or likely to affect the elements of the environment within the scope of subparagraph (a) above, and cost-benefit and other economic analyses and assumptions used in environmental decision-making”.

I believe that the documents withheld may fall under this definition, because the funding of the project is a “[programme], affecting or likely to affect the elements of the environment”.

Regulation 1049/2001, INEA conducts a fresh review of the reply given at
