Text messages from case 1316/2021/MIG
Dear European Ombudsman,
Under the right of access to documents in the EU treaties, as developed in Regulation 1049/2001, I am requesting documents which contain the following information:
Any texting messages received or sent by Mrs.Oreilly, or her cabinet team, or her lawyers, using services which includes WhatsApp, Signal and others similar, as related to the European Ombudsman investigation 1316/2021/MIG. Furthermore include any text messages about follow up media attention, for example today in Politico, since 2021.

I refer to your request of 17 July 2024 submitted via the online platform
[5]asktheeu, in which you seek public access to text messages sent or
received by the European Ombudsman ‘her cabinet team, or her lawyers,
using services which includes WhatsApp, Signal and others similar, as
related to the European Ombudsman investigation 1316/2021/MIG. Furthermore
include any text messages about follow up media attention, for example
today in Politico, since 2021.’ (sic)
Your request was registered on 17 July 2024 under the reference
Ares(2024)5304982. In accordance with Regulation 1049/2001, the time limit
for replying to your request expires on 12 August 2024.
We have interpreted your request as requiring access to firstly text
messages exchanged between various actors as regards the specific
Ombudsman’s inquiry referred to (case 1316/2023/MIG) and in addition, any
text messages exchanged concerning media attention as a follow up to that
inquiry.
Please note that, in line with the Ombudsman’s [6]Decision on Records
Management, the Office avoids using text messaging, instant messaging or
similar tools for substantive work communications.[7][1] Notwithstanding
the fact that we do not use this form of communication for our inquiries,
we searched for documents potentially falling within the scope of your
request by reference to various mobile messaging applications (such as
WhatsApp, Signal etc on mobile devices) and Cisco Jabber chat (instant
messages on office laptops and desktops). In order to identify relevant
documents in the possession of those actors, key search terms were used on
all relevant devices (mobile phones, laptops, desktops), regardless of
whether or not the messages were required to be registered in accordance
with the Office’s internal guidelines.[8][2] In line with the internal
guidelines on records management, where relevant messages were identified,
a screenshot of the message was taken, including the details of the sender
and recipient together with the date and time of the message (where
possible), imported into a WORD document and thereafter converted to PDF
format. Where there were multiple messages forming part of the same
message-thread or chat-thread, only the messages comprising the full
thread were identified in order to avoid unnecessary duplication.
Following those searches, a number of messages, relating to media
follow-up to the specific inquiry, were identified, which are attached to
this reply.
You will note that the documents are fully disclosed, save for the limited
redaction of personal data.[9][3] In order for personal data to be
transmitted to you, you must demonstrate that it is necessary for you to
have the data for a specific purpose in the public interest.[10][4]

Article 7(2) of Regulation 1049/2001 (‘confirmatory application’
procedure). You may do so by sending an e-mail to
