Dear Mr Gurney,

In reply to your request, we would like to point out that during the period 1994 - 2009 there was no EU Pension Scheme for Members of the European Parliament (MEPs). Indeed, until the moment the MEPs' single statute (http://eur-lex.europa.eu/legal-content/E...) came into effect, i.e. with the beginning of the 8th legislative term on 14 July 2009, salary and ordinary pension entitlements for MEPs were governed by national law.

Since 2009 under the new Members' Statute, former Members are entitled to an old-age pension from the age of 63. However, under Article 25 of the Statute, MEP's re-elected in 2009 had the choice to remain under the national provisions applicable to them up to that date. In consequence, the possibility to opt out from the EU Pension Scheme exists only since July 2009, but not for the period between 1994 and July 2009.

Until July 2009 Members could nevertheless opt for adhering to a voluntary pension scheme in accordance with the applicable rules. Opting out is in consequence not relevant and Parliament does not hold this information.
In view of these considerations, the European Parliament hereby kindly asks you, pursuant to Article 6(2) of Regulation 1049/2001, to further clarify the scope of your request.

Until reception of the clarification, the statutory deadline cannot run. In the absence of any answer within 20 working days, that is to say, by 8 February 2017, your application will be considered withdrawn and the file closed.

Kind regards,
