Dear Mobility and Transport,

Under the right of access to documents in the EU treaties, as developed in Regulation 1049/2001, I am requesting documents which contain the following information concerning regulatory cooperation between the EU and the US automobile standards and regulations concerning car safety, car emissions and e-mobility (since January 2003):

1) minutes and other reports of meetings between European Commission officials and/or representatives (including the Commissioner and the Cabinet) with their United States counterparts on automobile standards and regulations concerning car safety, car emissions and e-mobility (since January 2003).

2) all correspondence (including emails, letters) of European Commission officials and/or representatives (including the Commissioner and the Cabinet) with their United States counterparts on automobile standards and regulations concerning car safety, car emissions and e-mobility (since January 2003).

3) minutes and other reports of meetings between European Commission officials and/or representatives (including the Commissioner and the Cabinet) and representatives of companies and business associations on automobile standards and regulations concerning car safety, car emissions and e-mobility (since January 2003);

Dear Mr. DIELS,

 

Thank you for your request for access to documents concerning the
following documents:

 

1) minutes and other reports of meetings between European Commission
officials and/or representatives (including the Commissioner and the
Cabinet) with their United States counterparts on automobile standards and
regulations concerning car safety, car emissions and e-mobility (since
January 2003).

 

2) all correspondence (including emails, letters) of European Commission
officials and/or representatives (including the Commissioner and the
Cabinet) with their United States counterparts on automobile standards and
regulations concerning car safety, car emissions and e-mobility (since
January 2003).

 

3) minutes and other reports of meetings between European Commission
officials and/or representatives (including the Commissioner and the
Cabinet) and representatives of companies and business associations on
automobile standards and regulations concerning car safety, car emissions
and e-mobility (since January 2003);

 

I would like to draw tour attention on the following points:

 

1.- Unfortunately you have not indicated your postal address that is
required for registering and handling your request in line with the
procedural requirements. Please send us your full postal address at your
earliest convenience.

 

2.- The description given in point 3) in your application does not enable
us to identify concrete documents which would correspond to your request.
We therefore invite you, pursuant to Article 6(2) of Regulation (EC) No
1049/2001 regarding public access to documents, to provide us with more
detailed information on the documents which you seek to obtain, "the names
of representatives of companies and business associations".

 

With a view to safeguarding the interests of good administration, we
therefore see ourselves obliged to balance your possible interest in
access against the workload resulting from the processing of your
application.

This is in line with the case law of the EU Courts, ( Judgment of the
Court of Justice of 2 October 2014 in case C-127/13, Strack v Commission,
paragraphs 27-2!).

 

3.- Also, Also, we ask you to limit the scope of your request to a period
from January 2015, and not January 2003, so as to reduce it to a more
reasonable volume of identification and processing of documents.

 

4.- Please note that certain subjects of your request do not fall under
the competence  of DG MOVE. Therefore, we invite you to limit your request
to car safety and e-mobility. You might consider to introduce another
request to the DG concerned by car emissions (DG CLIMA) directly.

In accordance with Article 2, third paragraph of the Implementing Rules to
Regulation (EC) No 1049/2001 , the 15 working days time limit for handling

1) I would like to receive all the information electronically
2) I would like to receive all minutes and reports of meetings between European Commission
officials and/or representatives (including the Commissioner and the Cabinet) and representatives of:
- Car manufacturers
- Business associations representing car manufacturers
- Manufacturers of car supplies or their representatives
- Manufacturers of charging stations for electric vehicles
for those meetings that dealt with automobile safety standards and regulations and e-mobility (since January 2013);
3) I will limit the scope of my request to the period from January 2013 instead of January 2003.
4) I will introduce another request to DG CLIMA for the documents on car emissions.

For the reasons explain previously we ask you again to establish clearly what are exactly the car manufacturers, the Business associations representing car manufacturers, the Manufacturers of car supplies or their representatives and the Manufacturers of charging stations for electric vehicles concerned by your request.
Without this information we are not in a position to identify concrete documents which would correspond to your request.
We therefore invite you, pursuant to Article 6(2) of Regulation (EC) No 1049/2001 regarding public access to documents, to provide us with more detailed information on the documents which you seek to obtain.
