Transitional allowance of former MEP Szájer

Dear European Parliament,

Under the right of access to documents in the EU treaties, as developed in Regulation 1049/2001, I am requesting documents which contain the following information:

Has Mr Szájer requested a transitional allowance following the end of his term as an MEP on December 31, 2020? I am requesting access to all documents and correspondence between Mr Szájer and the European Parliament regarding this matter.

I am also requesting access to a copy of Mr Szájer's letter of resignation sent to the European Parliament.

Dear Mr Kozak,

 

The time limit for responding to your application of  1 April 2021 for
public access to documents under Regulation (EC) No 1049/2001 expired on
26 April 2021.

 

However, the consultations with regard to the detailed analysis of all
legal aspects of the documents concerned by your request requires more
time than expected, so that Parliament must exceptionally extend the time
limit provided by Article 7(1) of Regulation (EC) No 1049/2001 by a
further 15 working days in accordance with Article 7(3) of that Regulation
in order to reply to your application.

Under Article 13) of the Statute for Members of the European Parliament and Articles 45) and 48) of the Implementing Measures for the Statute for Members of the European Parliament , former Members having served a minimum of 12 months of mandate are entitled to a transitional allowance upon request. The monthly allowance is set at the same level as the Members’ monthly salary. Members will be paid one month’s allowance for each full year’s service they have completed, but not for less than six months or more than 24 months. Besides, where a former Member is entitled to payment of a transitional allowance and, at the same time, an old-age pension or an invalidity pension, he or she must choose between the two.

Information on whether an former MEP has asked for a transitional allowance is information concerning a person and is therefore personal data within the meaning of Regulation (EU) No 2018/1725. Under the terms of this Regulation, Parliament can only transfer personal data to a third party, like you, if there is a legal provision providing for the transfer, or where the third party has expressly demonstrated that the communication of the data was necessary in order to achieve an objective in the public interest, and that no less invasive way to achieve the objective is available. Since you have not established such a transfer necessity. Parliament is unable to communicate information on whether a particular MEP requested and is benefiting from a transitional allowance.

Please do not hesitate to submit a new application if you are interested in accessing other specific documents.
