Dear Commissioner Johannes Hahn, dear Director-General for Budget Gert-Jan Koopman,

Under the right of access to documents in the EU treaties, as developed in Regulation 1049/2001, we are requesting documents which contain the following information:

- two letters signed by Director-General for Budget Gert-Jan Koopman and sent to the Hungarian and Polish governments on November 19, 2021 arguing that problems with the independence of the judiciary, ineffective prosecution of corruption, and deficiencies in public procurement could pose a risk to the EU’s financial interests.

At the time of our request the existence of these letters has only been confirmed by a Tweet by EU Commission spokesperson Eric Mamer, after being disclosed by several leading media outlet. The latter also reported on - and therefore disclosed – the letters’ contents. See e.g. FINANCIAL TIMES, https://www.ft.com/content/ef1f2c45-c792... EURONEWS: https://www.euronews.com/2021/11/21/us-e... POLITICO EUROPE: https://www.politico.eu/article/eu-commi... and NEPSZAVA, https://www.nepszava.hu/3138615_cimboras...).

We look forward to receiving a prompt response.

Yours faithfully,

Alberto Alemanno, Jean Monnet Professor of EU Law, HEC Paris
