Types of services regulation notified to the Commission 2010-2015 (services notification procedure)
Dear Internal Market, Industry, Entrepreneurship and SMEs,
Under the right of access to documents in the EU treaties, as developed in Regulation 1049/2001, I am requesting documents which contain the following information:
- which types of services and/or measures were notified by Member States in the period 2010-2015 as a result of the notification procedure of the Services Directive.
The "Evaluation report – notification procedure of the Services" (annex to the impact assessment for the proposed Notification Procedure 2016/0398 (COD))[1] includes a "Table 1 Number of notifications per Member State in the period 2010-2015" (page 79).
The total number of notifications in this period was 1639. The table mentions that there were 127 notifications from the Czech Republic on "a prohibition of door-to-door sales of goods and services, notified by different municipalities", 620 notifications from Germany "on either funeral services or cleaning services, notified by different municipalities" and that some of the Dutch notifications "concern the 'General Municipal Ordinance' or 'Building Ordinance' notified by different municipalities."
The evaluation report does not mention which types of services and/or measures the rest of the notifications were about, hence this request for access to documents.
In the light of the Commission's proposal to strongly increase its oversight, scrutiny and veto powers concerning regulation of services by national, regional and municipal authorities, there is a clear public interest in enabling the public to know which types of services regulation were notified in the past in order to assess what lead the European Commission to conclude that the existing notifications procedure is not sufficient.
