Validity of UK-issued EHIC card from 1st Jan 2021

We're waiting for Rob McMullen to read a recent response and update the status.

Dear Taskforce on Article 50 negotiations with the United Kingdom,

Under the right of access to documents in the EU treaties, as developed in Regulation 1049/2001, I am requesting documents which contain the following information:

Details of any discussions, negotiations, decisions or agreements relating to the validity of a UK-issued EHIC card after 31st December 2020.

In particular, for example, on this NHS web page..
https://www.nhs.uk/using-the-nhs/healthc...
..it is asserted that:

"You'll still be able to access healthcare through EHIC for visits" [to the EU] "that begin after 1 January 2021 if you're either:"
[1] "a UK state pensioner living in the EU before 31 December 2020"
[2] "a UK student studying in the EU before 31 December 2020"
[3] "a 'frontier worker' (someone who works in one state and lives in another) before 31 December 2020, for as long as you continue to be a frontier worker in the host state"
[4] "an EU national living in the UK before 31 December 2020"

Yet all UK nationals living in the UK before 1st February 2020 will also have been
(a) 'living in the UK before 31 December 2020'
(b) 'living in the EU before 31 December 2020'
(c) 'EU nationals before 31 December 2020'

It follows that [1] must hold true for all UK state pensioners living in the UK before 1st February 2020, because the qualifying period does not exclude the prior one ending on 1st February 2020.

It also follows that [4] must hold true for all UK nationals living in the UK before 1st February 2020, because the qualifying period does not exclude the prior one ending on 1st February 2020.

The details of any discussions, negotiations, decisions or agreements relating to the validity of a UK-issued EHIC card after 31st December 2020 will hopefully by now have clarified whether the exclusion doesn't exist - as it appears not to have done, at least since that NHS web page was last reviewed on 30 January 2020 - or whether an exclusion of the prior period (before 1st Feb 2020) from the qualifying one (before 31st December 2020) has by now been added by agreement, rendering the important information provided by the NHS incorrect and misleading, potentially affecting more or less the whole of the UK population.

Thank you
Yours faithfully,
Rob McMullen
