Dear Council of the European Union,

I am writing to make a freedom of information request.

The European Commission for Democracy through Law (Venice Commission) is the Council of Europe's advisory body on constitutional matters and provide legal advice to its member states and, in particular, to help states wishing to bring their legal and institutional structures into line with European standards and international experience in the fields of democracy, human rights and the rule of law.

On September 29th 2021, the President of the Venice Commission signed the letter to the Chairman of the Supreme Court regarding candidates for the Ethics Council concerning the procedure for selection (appointment) to the positions of members of the High Council of Justice and the activities of disciplinary inspectors of the High Council of Justice.

I further suggest a strong public interest in this information being made public and agree to pay all reasonable searching, reviewing, and copying costs associated with processing this request.

If my request is denied in whole or in part, I ask that you justify all deletions by reference to specific exemptions of the act. I will also expect you to release all non-exempt material.

According to Article 19 of the Universal Declaration of Human Rights adopted and approved by the United Nations General Assembly Resolution 217A on December 10th 1948, and the European Convention on Human Rights on November 10th 1950, everyone has the right to receive and impart information and ideas without interference by public authority regardless of frontiers.

In that regard, I should be grateful if you would provide me with the following information under provisions of the Regulation (EC) No 1049/2001 of the European Parliament and of the Council of May 30th 2001 regarding public access to European Parliament, Council and Commission documents:

(1) Please could you list and provide copies of any correspondence including opinions, letters, emails and their attachments, any information that the Venice Commission hold concerning drafts of law and activity of the Ethics Council, High Council of Justice, Public Integrity Council and High Qualifications Commission of Judges in Ukraine including, but not limited to, written communications and notes of meetings (handwritten or electronic, drafts, memos, invitations, appointments, cancellations, attendance lists, agendas, background papers), audio or video recordings, verbatim reports, operational conclusions, lines to take, briefings, and presentations or telephone conversations concerning the above with Ukrainian and other countries authorities during 2014-2021.
