SUBJECT: Invitation to Tender

 

Dear Tenderer,

 

You are invited to submit your tender for the provision of “Project – Berbera & Bosasso Merchant Vessels Boarding & Training Capacity FWC 2020”, as set out in the attached Tender Dossier and present invitation to tender and instructions.

You are referred to in the Draft Contract as “tenderer” or “contractor”.

 

INSTRUCTIONS FOR SUBMISSION

 

By submitting the tender, the tenderer undertakes the responsibility to be eligible and not be in an exclusion situation ref. the Practical Guide for Procurement and Grants for European Union External Action (PRAG 2019) (https://ec.europa.eu/europeaid/funding/about-funding-and-procedures/procedures-and-practical-guide-prag_en).

N.B.: Tenderers are not obliged to use the template provided; however, they are required to provide the evidence that the person signing the tender documents on behalf of the tenderer is a duly authorized signatory

VALIDITY OF TENDERS

Tenders shall remain valid for a period of 90 days after the deadline date for submission above specified. The successful tenderer is bound by the tender for a further 60 days (ref. Section 2.9.5. of PRAG 2019).

 

EVALUATION OF TENDERS

The evaluation of the technical offers will follow the procedures set out in Section 4.3.9. of the PRAG.

 

SELECTION CRITERIA

 

Lot 1- Training Facility in Berbera

-          Legal and regulatory capacity: They must possess the necessary authorization to operate in the relevant project location, i.e., Berbera for Lot 1.

-          Economic and financial capacity: Their average annual turnover in the last three years (2017, 2018 and 2019) must be at least EUR 125,000.00 or above.

-          Technical and professional capacity: They must have successfully provided similar services under a least one (1) contract with an annual budget of at least EUR 125,000.00, which was implemented anytime during the period of three (3) years from the deadline for receipt of tenders.

Lot 2- Training Facility in Bosasso

-          Legal and regulatory capacity: They must possess the necessary authorization to operate in the relevant project locations, i.e., Bosasso for Lot 2.

-          Economic and financial capacity: Their average annual turnover in the last three years (2017, 2018 and 2019) must be at least EUR 125,000.00or above.

-          Technical and professional capacity: They must have successfully provided similar supplies under a least one (1) contract with an annual budget of at least EUR 125,000.00, which was implemented anytime during the period of three (3) years from the deadline for receipt of tenders.

 

Award Criteria:

The sole award criteria will be the price.

 

ETHICS CLAUSE

Tenderers must comply with the ethics clause referred to in Section 2.5.6. of PRAG 2019 on absence of conflict of interest, respect of human rights, environmental legislation and core standards, zero tolerance for sexual exploitation and sexual abuse, payments, professional secrecy, anti-corruption and anti-bribery.

 

CANCELLATION OF THE PROCEDURE

Ref. to Art. 171 of the Regulation 2018/1046 of the European Parliament and of the Council of 18 July 2018 (Financial Regulation 2018), the Contracting Authority may, before the contract is signed, cancel the procurement procedure without the candidates or tenderers being entitled to claim any compensation. The decision shall be justified and brought to the attention of the candidates or tenderers as soon as possible.

Should you need additional or clarifying information in order to prepare and submit your Tender, please, make a written request to the Contracting Authority by email.

Requests for clarifications must be received by the Contracting Authority before 13/05/20 at 16:00 Mogadishu time at the following e-mail addresses:

The Contracting Authority has no obligation to provide clarifications after the latter date.
