Regulation (EC) No 1049/2001 - GESTDEM 2022/4618
Dear Mr Ryan,
I refer to your e-mail of 1 October 2022, registered on 3 October 2022 , by which you
submit a confirmatory application in accordance with Article 7(4) of Regulation (EC) No
1049/2001 regarding public access to European Parliament, Council and Commission
documents1 (hereafter ‘Regulation (EC) No 1049/2001’).
Your confirmatory application was submitted in relation to your initial application of
15 August 2022 in which you requested, I quote:
‘
All documents held by Commissioner Reynders, his cabinet, and DG Just,
concerning the Irish Data Protection Commission and Ireland’s application
of the GDPR during the period from the beginning of the current
Commission’s term to the present date [15 August 2022]. Including all
documents in the meaning of Article 3(a) of Regulation 1049/2001, whether
long term records or short term notes, irrespective of whether they are

included in the eDomec or ARES systems. This also includes all relevant
papers, reports, presentations, speeches, minutes, notes, communications,
correspondence, agendas, minutes, and comments, whether hand written or
typed or otherwise recorded. This also includes but is not limited to all
communications and meetings with or concerning the Irish Data Protection
Commission itself, and relevant communications and meetings with the Irish
Government and other Commission DGs and European institutions and
agencies.’
The initial request was assigned to the Directorate-General Justice and Consumers. As
you did not receive an initial reply from that Directorate-General within the statutory
time limits, you submitted a confirmatory application on 1 October 2022.
In the meantime, the initial reply in question was sent to you on 7 October 2022
(registered under reference number Ares(2022)6923031).
Against this background, the Secretariat-General will close your confirmatory application
related to the lack of initial reply.
You remain entitled to submit a new confirmatory application in accordance with Article
7(2) of Regulation (EC) No 1049/2001, should you wish to request a review of the initial
reply of 7 October 2022.
